RESOLUTION OF THE CITY COUNCIL �,. , � NO: 1755 • " � - � • � �:� A RESOLUTION APPROVING A METES AND BOIINDS ' . SUBDIVISION OF A LOT LINE REARRANGEMENT � FOR THOMAS M. CROSBY, SR. � FILE NO. 895 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; � and WHEREAS , the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision regulations �or the orderly, economic and safe development of land within the City; and _ WHEREAS , the City Council has considered the application for a subdivision by Thomas M. Crosby, Sr. (herein- • after "the subdivider" ) of a property legally described on the certificate of survey attached to this. resolution; and WHEREAS, the subdivider has completed all requirements of the City: and WHEREAS, per Section 10.03, Subdivision 6 (C) of the Municipal Code,' the Council approves the creation of a sub- standard lot and further grants a permanent area variance to combined Parcels D & E legally described on the certificate of survey attached to this resolution based on the following findings : ` 1. The proposed subdivision of a lot line rearrangement does not increase the overall density of the total parcels.. 2. � The benefitting homestead property,' a severely sub- standard lot per the standa"rds of current RR-1B Rural Residential Zone, will now have additional area for future septic improvements. . . 3. The undeveloped property (combined Parcels D & E) has an adequate building�envelope and suitable area for a principal � � and alternate septic drainfield. 4. A permanent residence had existed on the undeveloped " building site up to 1979. • . 5. There are no undeveloped, contiguous lands available. . NOW, THEREFORE, BE IT RESOLVED, that the City Counci 1 � of the City of Orono hereby approves the metes and bounds . • division for Thomas M. Crosby, Sr. according to the legal descriptions shown on the certificate of survey by Vernon A. Nickols, dated April 2, 1985, and attached to this resolution subject to the following conditions: 1. Parcels A, B and C, as described on the certificate of survey attached to this resolution, shall be legally combined for tax purposes by the applicant, Thomas M. Crosby, Sr. - . 2. Parcels D and E, as described on the certificate of � survey attached to this resolution, shall be legally combined for tax purposes by the current owner, Eleanor Lawler Pillsbury or her authorized agent. • 3. All future construction on combined Parcels D and E, as � described and shown on the survey attached, that involves the alterati<�n of the flood plain must be reviewed and approved by the Department of Nature Resources before a building permit can be issued by the City of Orono. 4. The tested septic site areas on combined Parcels D and E, as decribed on the survey attached, must be staked and protected prior to construction. 5. The resolution, and attached certificate of survey shall be filed with the Hennepin County Recorder's office on or before November 13, 1985. The approval granted by this Resolution shall expire if the division has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City Council of Orono, Minnesota, this 13th day of May, 1985.
