RE: Lakeshore Retaining Wall
Dear Mr. Redmond:
It has come to the attention of the City that you have contracted with Sanders Landscaping to
alter the retaining wall and grade on your lakeshore. City ordinances prohibit construction,
grading, tree removal and hardcover within 75' of the Ordinary High Water Level of the lake.
When the wall was originally constructed it was done without City approval. When the Ciry
Council did grant a conditional use permit for the wall, it was under specific conditions.
Enclosed is a copy of the resolution for your review. This resolution is also filed on the Chain
of Title for the propeny and sh�uld have been brought to your attention at closing.
You have the right to ask City Council to approve alterations to the wall, but it was a difficult
after-the-fact application the first time and it would again be a very difficult application to
approve. The application process can take from 6 weeks to many months. Therefore, the City
must require you to return the wall`to the height approved by Resolution No. 2538, plantings
must be restored and hardcover under the sand blanket must be removed. A deadline of August
22, 1994 has been established for completion. If this deadline is not met, the City will issue
citations and refer the matter to the City Council for further action.
