Hi Melanie,
I've completed a zoning review for 2691 Casco Point Road and have the following questions:
1. 78-1680 doesn't seem to allow boathouses or decks within 75' of OHWL. Correct. Yet the
definition of a water-oriented accessory structure includes boathouses, gazebos and detached decks.
Is there something I'm missing or are these not allowed? only those listed in code sections �8-128� &
78-1282 are permitted within 75'of the OHWL.
2. How do I find the regulatory floodplain elevation referred to in 78-1280? RPFE Section 78-lili
- 931.5'is the 100-year flood elevation for Lake Minnetonka. The RFPE is 932.5', lowest floor. The
Minnehaha Creek Watershed District has a 933.5'lowest opening provision.
3. It appears that this lot is smaller and narrower than allowable. Does this result in any
limitations on what we can do when remodeling? Interior remodeling? No.
4. It appears that the house is .9' closer to OHWL and garage is .8' closer to side yard setback
than allowed. Do I understand correctly that additions are allowed as long as the new construction
meets all setback and height requirements? Expansions of the home's volume, height and/or footprint in
areas of non-confoming setbacks are not permitted.
5. The average lakeshore setback is measured from the "shoreline". Is "shoreline" the same as
ordinary high water? Yes.
