As per your request regarding confirmation that this project will be less than 50 cubic yards of grading,
excavating, filling ar stock piling on site,please review these simple calculations that we will not exceed 50
cubic yards.
Installation of proposed retaining wall:
65 linear feet x 4 1/2 feet height x 12" - 24" wide= 19.50 cubic yards
Excavation and back fill of proposed retaining wall:
65 linear feet x 4 1/2 feet height x 12" - 24" wide = 19.5 cubic yards
Your immediate approval would be greatly appreciated. Our clients are anxious to start work on this project.

Attached is the Property Owners Acknowledgement Form with signatures of Dave and Lynn Guttermuth.
I was going to be meeting with Dave Guttermuth this evening at 6:00 at the property, but have cancelled that
appointment until I hear from the City.After speaking with Dave, he is all for the project.
I have requested the survey company (Gronberg) to make the required changes regarding contours and erosion control
measures and return to me.
Minnehaha Creek is sending me the permit, which I will fill out immediately.
Please let me know if there are other steps that need to be taken.

1. I assume the applicant has the permission of the neighbors to remove the old wall? You
mentioned an Access Permit was submitted with your application. I'm not sure what you are
referring to and I don't see an Access Permit, but the City needs written confirmation from the
neighboring property which the work will be performed on, stating they are in agreement with
the proposed project and allow access onto the property.
2. The site plan does not depict any erosion control measures. See#4 below.

3. Contours are not shown in area of proposed work per the City's Survey/site plan requirements.
' According to the City's Survey Requirements (copy attached) existing topography, proposed
grading and erosion control measures must be shown.
4. As mentioned, your project may trigger the Minnehaha Creek Watershed District's (MCWD)
permitting requirements. As noted on our permit application (copy attached),they can be
contacted at 952-471-0590. Please note the City will not issue a building permit without a copy
of the MCWDs permit or documentation from the MCWD stating the proposed project does not
trigger any of their permitting requirements.
The above information is required in order for the plan review to continue. Please feel free to contact

It is my understanding based on conversation with Christine Mattson that there is further need for
authorization from the neighbor and Minnehaha Creek Watershed with regard to the retaining wall.
Please advise me as to your decision in hiring Gronberg for further work and expense regarding items#2

I was going to be meeting with Dave Guttermuth this evening at 6:00 at the property, but have canceiled that
appointment until I hear from the City.After speaking with Dave, he is all for the project.
I have requested the survey company (Gronberg)to make the required changes regarding contours and erosion control
measures and return to me.
Minnehaha Creek is sending me the permit, which I will fill out immediately.

AGREEMENT made this vl day of /, L , 2015, by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City") and Bill & Julie nyder("Owners").
Recitals
1. A land use application has been filed for approvals to construct retaining walls located at
2677 Casco Point Road the ("Subject Property"), legally described as Lot 135, Spring Park, Hennepin County
Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (inciuding planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with la ' ' n#46-��#4 if compliance with the

3. MONTHLY BILLING. As the City receives consultant biils for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpai alance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
