HomeMy WebLinkAboutResolution 1709 �, -:z_ ;, ' r, � y �• �7:„ • � . •�. . � • - Cit� o� ORONO r �-� ��-� �� . :,� . � . f ,�"�� RESOWTION OF THE CITY COUNCIL °�• ` 1709 . :�,: ����; No. • • •;' . � _ "�'�' - A RESOLUTION APPROVING THE PLAT OF PAINTERS CREER FILE NO. 804 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City �of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and � WHEREAS , the City Council has considered the application for a subdivision by Painters Creek Development Corporation, an Illinois Corporation authorized to do business in Minnesota, (hereafter "the subdivider") ; and ' WHEREAS, on April 23, 1984 the City Council granted approval of the preliminary plat of a 10 unit Planned Rural � Residential Development that designated the building and septic envelopes for each of the residential units (hereafter referred to as "Development Plan"). Each septic envelope maintains a 20 foot setback from each building envelope and boundary line of each unit. Each building envelope maintains the approved setbacks as follows: Front/street setback of 50 .feet Side setback of 20 feet WHEREAS, the Development Plan has been found to meet all standards of the Planned Residential Development Code, On- Site Septic Sewage Treatment Code and all other pertinent , sections of the zoning and platting codes that deal with the rural development of property within the City, so that each pad � can be developed as a single family residential unit without the need of variances; and WHEREAS, Outlot C is not platted as part of this scheme but is intended for .future development. Al1 future development of Outlo� C will be : subject to all requirements of the then current zoning and Community Management Plan of the City; and � page 1 'of 3 �. � . : . NO. 1709 . • ', �,,} • ; . . .,s � WHEREAS, the subdivider has completed all requirements of the platting regulations of the City, including: 1. Dedication of drainage and utility easements. _ 2. Dedicationon the plat of right of way for a public � road, shown as County Highway No. 84. 3. Creation of a new private road shown on the plat as Outlot E, to be know henceforth as Luce Line Ridge. 4. Concurrent with the creation of this private road, the Subdivider has dedicated to the City a Road and Utilites Easement granting to the � City permanent access, improvement and utility easements over said Outlot; the Subdivider has created non-exclusive ingress, egress, drainage and utility easements over � said Outlot in favor of all abutting and/or benefiting lots including a declaration of certain maintenance covenants wherein each of the abutting and/or benefiting lot owners covenants and agrees to . permanently maintain and pay the cost of maintenance for said private road. 5 . Dedication to the City of a Flowage and Conservation Easement providing for limitations on the use of wetlands and/or drainageways described therein and shown on the plat as "drainage easements". 6. Dedication to the City of a,n open space easement over Outlots A & B to fulfill the density requirement for 10 residential units in the RR-lA rural residential zoninq district requiring five acres of dry land per unit. 7. Creation of private covenants placing restrictions on the use of each homestead unit, private road and shared commons area. 8. Payment to the City of a Park Dedication Fee in the amount of $1, 000 . 00 . 10 . Payment to the City for the legal review and filing of the plat, easements and covenants in the amount of $75 . 00. NOW, THEREFORE, BE IT RESOLVED, that the City Counci 1 of the City of Orono hereby approves the plat of Painters Creek, Hennepin County, Minnesota; subject to the following conditions: l. Outlot D is set aside for the septic expansion and exclusive use of the property located at 4740 Bayside Road , legally described as the West 1/2 of the Southwest 1/4 of the Southwest 1/4 of Section 31, � Township 118 , Range 23 North except that part of the . South 226 feet thereof lying East of the West 249 feet thereof and West of the East 180 feet thereof. • 2. Access to residential units 1 through 9 shall be via Luce Line Ridge. Access to residential unit 10 must be approved by the Hennepin County Highway Department prior to issuance of building permit for new residence. 3 . The aforesaid plat shall be filed by the City of Orono with the Hennepin County Recorder's Office on or before June 10, 1985 together with a certified original copy of this Resolution and executed copies ofthe Easements & Covenants as noted above. The approval granted by this Resolution shall expire if the plat has not been filed by the clate specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review.
