A RESOLUTION APPROVING THE PLAT OF
� WILLOW PROPERTIES ADDITION
FILE NO. 806
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota;
and
WHEREAS, the City Council of the City of Orono has
adopted subdivision regulations for the orderly, economic and
safe development of land within the City; and ,
WHEREAS , the City Council has considered the
application for a subdivision by Willow Properties, a co-
partnership consisting of W.D. Gagne, Paul G. Roberts, Albert B.
Yngve and Harold VandenElzen, the subdividers; and
WHEREAS, the subdivision has been found to meet all
• standards of the RR-1B zoning district finding that each lot is
of a size and configuration that will allow each lot to be fully
developed without the need of any variances; and
WHEREAS, the City -Council hereby approves a special
exception to Comprehensive Sewer P1an, Rura1 Sewage Treatment
Policy No. 7 to allow sewer service to Lot l, Block 1, Willow
Properties Addition based on the following findings:
1. The sewer project (LS-67-1 ) was assessed and
constructed in 1967 prior to the adoption of Orono's
Comprehensive Sewer Plan. .
2. The Property is already serviced by an existing
sewer service stub. Connection will not involve
� extension. of the municipal line.
3. Unit,. capacity is available within the municpal
line.

. 4. The property was assessed 3 sewer units in the LS-
67-1 sewer project.
5. Zoning will remain rural and all. development will
occur in strict conformance with the rural district
requirements including use, lot size, setbacks and all
pertinent rural performance standards.
WHEREAS, Lot 2, Block 1 and Outlot B are not platted as
part of this scheme but are intended for future development. All
future development of these properties shall be subject to all
requirements of the then current zoning and the Community
_ D4anagement Plan; and . -
� � WHEREAS , the subdividers have ' completed all
requirements of the platting regulations of the City, including:
l. Dedication of drainage & utility easements.
• 2. Dedication on the plat of right-of-way for a public
road, shown as Old Crystal Bay Road, Willow Drive North
anc� U.S. Highway No. 12.
3. Creation of a new private road shown on the plat as
Outlot A.
4. Concurrent with the creation of this private road,
the Subdivider has dedicated to the City a Road and
Utilities Easement granting to the City permanent
access, improvement �and utility easements over said
Outlot.
5. Submitted written notice to the City advising that
2 of the 3 sewer units already assessed against the
property shall be assigned to Lot 1, Block 1, Willow
Properties Addition.
6. Payment to the City of a Park Dedication Fee in the
amount of $200. 00 .
7. Payment to the City f or the 1 ega 1 review and f i 1 ing
of the plat easements and covenants in the amount of
$75. 00. �

NOW, THEREFORE, BE IT RESOLVED, that the City Counci 1
of the City of Orono hereby approves the plat of Willow
Properties Addition, Hennepin County, Minnesota; subject to the
following condition: .
1 . . Access for � Lot 1 , Block l , Willow Properties
Addition, on Old Crystal Bay Road must be approved by
the Public Works Coordinator.
� 2. The aforesaid plat shall be filed by the City of
Orono with the Hennepin County Recorder's Of f ice on or
� before June 10, 1985 together with a certified original
copy of this Resolution and executed copies of the
easements and covenants noted above.
. The approval granted by this Resolution shall expire if
the plat has not been filed by the date specified above. In that
event, it will be necessary to file a new application with the
City of Orono for subdivision review. �
• Adopted by the City Council of Orono, Minnesota, this
lOth day of December, 1984 .
