The City Council has considered this application including the findings and recommendations of the Pianning Commission, reports by City staff, comments by . tY�e owner and the effect of the proposed variance on the health, safety and welfare of the community. � 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district: • ti�at granting the variance would not adversely affect t�affic conditions, light air nor pose a fire hazard or other hazard or other danger to neighboring property; would not merely serve as a convenience to the owner, b�t is necessary to alleviate a demonstrable hardship , or difficulty; is necessary to preserve a substantial property right of the owner; and would be in keeping with the spirit and intent of the Zoning Code and ' Comprehensive Plan of the City. Conclusions, Order and Conditions Based upon the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code SectiQn 10 . 44 , Subd 5 (D) and (E) to permit co�struction of a commercial building 10 f eet f rom the rear lot line instead of the 35 feet required, and approve a 10 foot rear yard instead of the 30 feet required, subject to the following conditions : 1. As per Orono Zoning code requirements, applicant is s�abject to a commercial �site plan review upon a�plication for a building permit. � 2. Applicant shalldesign the structure so asto eliminate the possibility of direct access to the roof by • neighborhood children. 3. Authorities granted by this variance run with the . property not with the owner, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date September 10 , 1985. < ` r u ��� Ci.t� of ORONO � �� 5 RESOLUTION OF THE CITY COUNCIL � 1674 NO. • � • � 4. Violation of or noncompliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5 . The undersigned owner has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain , of title to the property. Thompson (hereafter "the applicant" ) has an interest in the property located at 250 Old Crystal Bay Road within the City of Orono (hereafter "City" ) , and legally described as follows : That part of Lot l, Auditor' s Subdivision Two Hundred twenty-nine (229 ) , Hennepin County, Minnesota, according to " the plat thereof on file or of record in the office of the Registrar of Titles in and for said county, lying Southerly of .a line drawn parallel with and 240 feet Southerly of , as measured at right angles to, the North line of said Lot 1 and lyinq Westerly of a line drawn parallel with and l, 070 feet Easterly of, as measured at right angles to, the West line of said Lot 1 (hereinafter "the property" ) ; and • WHEREAS, the applicant has applied to the City for a variance to Municipal Zoning Code Section 10. 20 Subd 3 (K) to permit the keeping of horses for the purpose of breeding, training and sale to the public. The property is located in the RR-1B Single Family Rural Residential Zoning District. 3. The Orono Planning Commission reviewed this application on August 20 , 1984 and recommended approval of the proposed variance based upon the following � findings: a) The applicant' s principal residence will be � located on the property. b) The proposed application requires no additional � variances to the performance standards for the keeping of domestic animals.
