RESOLUTION OF THE CITY COUNCIL

A RESOLUTION APPROVING THE PLAT OF
HARTZELL ADDITION .
WHEREAS, tYie City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe
development of land within the City; and
WHEREAS, the City Council has considered the application
for a subdivision plat by James R. Hartzell , the subdivider ; and
' WHEREAS, the subdivision has been found to meet all
standards of the LR-1C Zoning District finding that each I.ot is of a
size and configuration that will allow its use as a single family ,
residence to be developed without the need of any variances; and
• WHEREAS, the subdivider has completed all requirements of
the platting regulations of the City, including : ,
1 . Dedicat.ion on the plat of drainage and utility easements.
2. Dedication on the plat of right of way for a public street shown
as Casco Point Road. �
3. Payment to the City of a Park Dedication Fee in the amount of
$440. 00.
4. Payment to the City for the legal review and recording of the
plat and aIl documents related thereto in the amount of $75. 00.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the '
City of Orono hereby approves the plat of Hartzell Addition, Hennepin
County Minnesota; subject to the following conditions:
I. Lot 1 is to be developed according to all standards of the L'R-1C
Zoning District and all pertinent standards of the Municipal Code
. forlakeshore development. The existing tenniscourtcreates an
excess of 9� hardcover over the al.lowed amount of 3,275 sf or 25�.
The tennis court must be removed prior to development of Lot I.

2. Lot 1 is not riparian to Lake Minnetonka and a future owner is
placed on noticethatthe City' s subdivision regulations will not
� permit the creation of private easements granting riparian
access.

3. Access to Lot 1 must be approved by the Public Works
Coordinator .
4. The aforesaid plat shall be filed with the Hennepin County
Recorder ' s Office by the City of Orono on or before January 23,
I985, together with acertified originalcopy of thisResolution.
The approval granted by this Resolution shall expire if the plat has not
been filed by the date specified above. In that event , it will be
necessary to file a new application witk� the City of Or.ono for
subdivision review.
Adopted by the City Council of the City of Orono , Minnesota at a regular
meeting held July 23, I984.
