HomeMy WebLinkAboutResolution 1645 -. . . . . _ -. � .- . .. . ... t � r $ �� Clt of ORONO � • � RESOLUTION OF THE CITY COUNCIL � NO. 1645 • ' • • � � RESOLDTION TO WITHDRAW A REQUEST FOR A PUBI�IC HEARING ON NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT #MN0024091 FOR THE MAPLE PLAIN WASTEWATER TRL�ATMENT PLANT Wher•eas, assurances have been made by the Metropolitan Council, Pollution Control Agency, and Metropolitan Waste Control Commission that the Orono Comprehensive Plan will not be compromised and that service hookups to the Maple Plain-Long Lake-Orono Interceptor will not be allowed by Orono citizens; and Whereas, it is the City Council' s understanding that the • construction of the Maple Plain-Long Lake-Orono Interceptor will not incur any assessments to the City of Orono or any of its citizens; and • Whereas, the Maple Plain-Long Lake-Orono Interceptor is being constructed to solve an immediate problem (outdated treatment plant in Maple Plain and resultant phosphorous load into Painters Creek/Jennings Bay) and not to generate leap frog development in the rural area of Orono; and . Whereas, the City of Orono, through its adopted Comprehensive Plan, which in turn was approved and accepted by the . Metropolitan Council can maintain its governmental ability to � determine rate and type of development in the rural area affected by the interceptor and determine and maintain development standards; and . Whereas, it is unlikely that additional expenditures in opposition of the interceptor will accomplish a reconsideration of the - alternatives. Now, Therefore, Be it Resolved that the City Council of the City of Orono• does direct the City Administrator to inform the Minnesota Pollution Control Agency of our intent to withdraw our request for a public hearing on the NPDES permit for the Maple Plain Wastewater Treatment Plant. Now, Therefore, Be it Further Resolved, to reconsider the motion by Adams/Hammerel of May 30, 1984, authorizing $6,000 funding for the preparation and presentation of the contested case hearing of Orono vs Minnesota Pol�ution Control Agency on the Maple Plain-Long � Lake-Orono Interceptor. � , v, .1 '��` ' . • . . . • � • � . . , . . . � . . . . .;, . � yy • . Cit� o� ORONO � � ` RESOLUTION OF THE CITY COUNCIL � NO. 1645 • � • • . � �• Now, Therefore, Be it Further Resolved, that the extensive costs of proceeding with the contested case hearing and in light of the lack of support for the premise of detrimental impact on the environment arfd the ecology from the Lake Minnetonka Conservation District, Metropolitan Waste Control Commission, surrounding cities, and state agencies, the City Council directs staff to cease any expenditure of funds because of or on behalf of the Maple Plain Sewage Treatment Plant Interceptor as of June 5, 1984 . Let it be understood that any bills or�claims to the City for costs incurred prior to this date shall be honored and paid.
