A RESOLUTION APPROVING THE REQUEST OF
. PAINTERS CREEK DEVELOPMENT CORPORATION
TO APPLY FOR A BUILDING PERMIT PRIOR TO
FINAL SUBDIVISION APPROVAL
WHEREAS, the Planning Commission and Council have received
and approved a preliminary subdivision .of a Planned Residential
Development for Painters Creek Development Corporation, hereafter
applicant, on April 23, 1984; and
WHEREAS, the applican't has fulfilled all of the requirements
as setforth during the review of the preliminary subdivision for a
Planned Residential Development including the submission of required
septic test data and septic system design for. all rural residential
units; and �
WHEREAS , the applicant has asked� Council to approve the
issuance of a building permit for Lot 4 of the plat, Painters Creek,
� prior to final subdivision appro�al: �
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby
approves the request of Painters Creek Development Corporation to
apply for a building permit prior to final subdivision approval subject
to the following conditions: �
l. Prior to the issuance of a building permit, applicant must
complete or submit the following:
a) Remove existing residence on property defined as 31-118-23 -
. 34-0001, a demoliti.on permit is required by the City
b) Access to be constructed to site and approved by City
providing safe and suitable access fo��� City inspection "
� vehicles "
_ c) Survey of Lot 4 designating house, primary and alternate
septic sites and access drive
2 . Al1 construction shall be subject to ..the reguirements of the �
State Building Code ,
. 3. A Certificate of Occupancy will not be issued until the plat of
Painters Creek has been filed by the City with the �Hennepin
� County Recorder' s Off ice �

4 . The applicant agrees to. assume full risk in applying for a
building permit prior to final plat approval by the City
and that the City issues this building permit with the
knowledge that the �ite is pro��ided with suitable area for
a primary and alternate septic system and that the lot meets
all standards of the RR-lA zoning district .
5 . The undersigned owner has read, understood and hereby agrees
to the terms of this resolution
Adopted by the City Council of the City of Orono, Minnesota at a
regular meeting held April 23 , 1984 .
