RESOLUTION OF THE CITY COUNCIL
NO. 16 21

� A RESOLUTION APPROVING THE PLAT OF
KELLY COVE
WHEREAS, the City of Orono is a municipal corporation
. orgainzed and existing under the laws of the State of Minnesota; and
: WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development
� of land within the .City; and � � '
WHEREAS, the City Council has considered the �application for
a subdivision plat by Daryle L. Uphoff , the subdivider; and
WHEREAS, the subdivider has completed all requirements of the
platting regulations of the City including: .
i . . l. Dedication ori the plat ,of drainage and utilities easements
� � � � � 2 . Creation of private covenants to assure the continued
upkeep and maintenance of all shared improvements located
within Outlot A, Kelly Cove
� - 3 : Payment .to the City for outstanding sewer and water charges
. not collected at the time the property was originally
. � . • subdivided in the amount of $935.00
" , 4 . Payment to the City for. the �legal review and filing of the
- _ final plat and private covenants in the amount of $75 .00
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
Gity of Orono hereby approves the plat of Kelly Cove, Hennepin County,
Minnesota, subject to the following conditionsc
� � _ � l . A single family detached dwelling may not be constructed
� � . on Lots .l, 2 , 3 , & �4 , Block l, Kelly Cove �
� ' 2 . � Outlot A, Kelly Cove, may never be used for future .
resider�tial construction, but shall remain as an open
. space area as density credit for existing duplex units
on Lots l, 2 , 3 , & 4 , Block 1, Kelly Cove. .Residential
docks� may. never be constructed on the shoreline of Outlot A,

� 3. All conditions of Resolution 1058 approving the plat
of Navarre Cove, which applied to the property now
redivided as Ke1ly Cove, shall continue in effect
including the flowage and conservation easement over
the wetlands area, continued use of Outlot A, Navarre
Cove, as joint use dock area, private easements for
walking purposes via Lot 3, Block 1 , Navarre Cove
4 . The aforesaid piat shall be filed by the City of Orono
with the Hennepin County Recorder' s Office on or before-
October 23, 1984 together with a certified original copy
of this resolution and all other documents noted above.
� The approval granted by this Resolution shall expire if the plat has
not been filed by the date specified above . In that event, it will be
. necessary to file a new application with the City of Orono for
subdivision review.
Adopted by the City Council of the City of Orono, Minnesota at a regular
meeting held April 23 , .1984 .
