RESOLUTION OF THE CITY COUNCIL

GRAAiTING A CONDITIONAL USE PERMIT
TO MUNICIPAL ZONING SECTION 16.28 SUBD. 3 (D) - FILE 8H7
Whereas, Hennepin County (hereafter referred to as
"applicant") has an interest as a contract purchaser in the
property located at 630 Old Crystal Bay Road and Wayzata B1vd.
(U.S . Highway No. 12 ) within the City of Orono (hereafter
referred to as "City") , a property legally described as Lot 1 ,
Blockl , Willow Properties Addition, (hereafter referred to as
"property") ; and
Whereas , the applicant has applied to the City for a
Conditional Use Permit per Miunicipal Zoning Code Section 101.28
• subdivision 3 (d) to permit the construction of a community
library on the property.
Now, Therefore Be It Resolved by the City Council of
Orono, Minnesota: �
Findings
l . This application was reviewed as Zoning File No. 8P�7 .
2 . The property is located in the RR-1B Rural Residential
Zoning District.
3. The proposed building shall serve as a community �
library. .
. 4 . On February 21 , 1984 , the Orono Planning Commission
voted unanimously to recommend approval of the proposed
library use for the property.
5. On February 27, 1984, the Orono City Council approved an
amendment � to the Zoning Code adding Section 1�.28 Subdiv
3 (D) permitting a library use with a Conditional Use
Permit within the RR-1B Zoning District finding the use
• compatible with the intent of the RR-1B Zoning District,
Municipal Zoning Code and Comprehensive Plan.
6. On March 26, 1984 , the Orono City Council reviewed the
applicant's site plan dated January 3 , 1984 , project
number 003f�203 and approved the site plan based on the
� following conditions:

a) The principal structure of approximately 3 ,�10� sf
will be relocated on final site plan so that the �
structure shall maintain a minimum 5� foot setback from
all adjoining right of ways.
b) The proposed parking area of 39 stalls will maintain
the required setbacks as follows:
,. 1 ) 1P1 feet from residential north and east property
lines .
2) 201 feet from edge of street right of ways .
• c) Lot lines to be adjusted so that the library site
contains 2 acres in area.
d) A vehicular access will be provided to the library
site via Old Crystal Bay Road North.
7 . The City Council has considered this application
including the reports by staff and comments of the
app 1 icant and the ef fect of the proposed 1 ibrary use on
the health, safety and welfare of the community.
8 . . The City Council finds that granting a Conditional Use
Permit to allow the proposed library use of the property
would not adversely affect light, air nor pose, a fire
hazard or other danger to neighboring properties, nor
will this use depreciate surrounding residential
property values and the proposed level of use of the
property wi 11 be in keeping with the� intent and
objectived of the Zoning Code and Comprehensive Plan of
the City.
CONCLUSIONS, ORDER AAiD CONDITIOL�dS
Based upon the above findings, the Orono City Council hereby
grants a Conditional Use Permit to Hennepin County allowing a
• community library to be built on the above described property per
Section lfd.28 subdiv 3 (D) of the Municipal Code based on the
following conditions:
1 . Prior to the issuance of a . building permit , the
applicant must complete the following.

, a) Drainage plans to be reviewed and approved by the
City of Orono and the Minnehaha Creek Watershed
District.
b) Landscape plans reviewed and approved by the City -
plans to address need for screening along east and north
property lines excluding fences and masonary walls.
Planting schedule should be included.
� c) Location of vehicular access off Old Crystal Bay Road
must be approved by the Public Works Coordinator .
d) Signage plans to be approved by the City.
� e) City to determine S .A.C. , sew2r and water unit
charges upon review of preliminary building plans .
2. . Prior to the issuance of a bui lding permit for the
community library, the plat that creates the 2 acre site
must have received final plat approval from the City of
�rono.
3. Violatiori of or noncompliance with any of the terms
and conditions of this resoultuon shall constitute a
violation of the Zoning Code, shall automatically
terminate any authority granted herein.
� 4. The undersigned applicant has read, understood, and
� hereby agrees to the terms of this resolution.
5. The acceptance of this conditional use permit by the
Hennepin County Board will be conditioned upon the
granting . of title to the property by the owner ,
recording of the deed, and shall require approval by the
County Board subsequent to the filing of the deed and
all other necessary documents.
