Eric,
To follow up on our phone conversation, I did discuss the following with the City:
1. You asked me if a pipe could be installed in the swale on the City property during the reconstruct project, which I did
not approve.
2. At a later time during the project, you asked the General Contractor to install a pipe in the swale, and they did.
3. The City agreed to split the cost of sealing your driveway, as a result of concrete color difference during the
reconstruct project.
4. Once the pipe on the City property was discovered, the City required that it be removed by June 1, 2011, or they
would not reimburse the driveway sealing costs.
5. The City reviewed it's policy on work within their property, and it has to be completed by the City, or by a Contractor
hired by the City. As a result the driveway sealing cost will not be reimbursed, but be put towards removing and
restoring the pipe and swale.
6. You contacted me regarding the sealing, and felt that it should be reimbursed.
Following this discussion, the City's position on this issue has not changed. The City will restore the swale to it's condition
prior to the pipe installation and the invoice will not be reimbursed.

Eric,
The City has revisited the pipe installed on the City property adjacent to your property. Any work on the City property
will need to be completed by the City or a Contractor hired by the City. As a result, the City will remove the pipe, restore
the swale to the condition prior to the pipe installation and the driveway invoice will not be reimbursed.

Eric,
I reviewed the invoice with the City of Orono. The City is willing to pay $500.00 of the attached invoice to seal your
driveway, as discussed in previous voicemails. Payment will be made by the general contractor to the Hawkins Tree and
Landscaping, Inc.
City staff said there is another issue related to your property. The swale that the City graded on the parcel adjacent to
yours has been replaced with a pipe and fill. This work was not authorized. As a result the City will withhold payment for
the driveway sealing until the swale is reinstated and restored on the City parcel, and the fill and pipe are disposed of, off
of City property.
Please let me know when this work is finished and we will process a payment. The work will need to take place prior to
June 1, 2011, because the project will be closed out and there will be no way to reimburse you for your driveway.
