Hennepin County, Minnesota, (hereinafter"the Property"�;; and ' #�IEPEAS, the Applicant��ave r4��ie application to the City for a variance � from C�r�r�ro City Cod��ection '��-350 whicft r�ires a 30-foot rear street setback to permit constrlt�fion of second �ry addiff��29.9 feet from the rear street property line; and WHEREAS, th�Applicar�ts have made application to the City for a variance from Orono Gity Code Secft�rt 78-350 which requires a 10-foot side setback to permit construction of �scpnd story ac�dition over the garage as close as 6 feet from the side property tine and ovasf the lal�•side of the home as close as 8 feet from the side property where a 10 foot setbaCt�is r�qUired; and WHEREAS, the Applicants have made application to the City for a variance from Orono City Code Section 78-1403 to permit 3,321 square feet {19.5%) structure on the property where 2,549 square feet or 15% structural coverage is permitted and 3,033 square feet (17.8%) currently exists in conjunction with construction of a new lakeside deck; and Page 1 of 7 ' � l�em-1 l-('C Agenda-12/08'201-F ' File�!l�1-3697('l'o�alPages 11�!/ WHEREAS, the Applicants have made application to the City for a variance from Orono City Code Section 78-1700 to allow 4,898 square feet or 28.8% hardcover on the property where 4,248 square feet or 25% is permitted in conjunction with construction of a new lakeside deck; and WHEREAS, after due published natice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Codei tf'ie�Orono Planning Commission held a public hearing on November 17, 2014, at which tim�s all persons desiring to be heard concerning this application were given the opportunity tA�pet�k thereon. , WHEREAS, The F'lanning Carnr�ission re��ved this application on November 17, 2014, the Planning Commissio�t �tated on two s�p�rate motions. The first motion was to recommend approval of the �si3de and rear setbac��ariances allowing the second story additions as proposed. This mo�� passed with a 5 to O vqf�: A second motion regarding approval of the requested hardcover�d struct►�ral coverage v�iances to permit construction of a lakeside deck passed with a 4 �a 1 at�#� and was conctit�pned upon the following: a. Removal of the deck/lartding �nd stair on fk��.south side af the home; the door should be converted to a vv�ndou�. b. The deck must be constructe�!as"�f'Yt�OLS° and t��:patio below removed. c. No expansian, enclosures at �hanges to ths footpr�rtt or the nature of the deck would be permit�-in the ft�ture withc�ut fiiitli�.r' Plarrning Commission and city Council a�p{�rovals. WHEREA�, on :; Alavember ' '[7, 2014, the Planning Commission's recommend�tfons were ba�e:d pn�fo�wing ftnt�Sngs. PLAN�IING COMMI3SION FINDINGS 1) Resolu�ion No. 4640, a�apted in 2fl01, granted variances to the property regarding the 6 foot side setback for the g�cage, the side setback variance allowing the second story and permitted 2,�61 square fe�t�17.4% as adjusted based on current Iot area calculations) of structural coVu��age. 2} The second story additians to the home are proposed to be constructed over the existing footprint of the home. 3) The variance to allow construction over the existing home within the 10 foot side setback will alleviate a practical difficulty inherent to the Property's width and not created by the Applicants. File�1�-3697/To1a1 Pages I1-1J i 4) The Applicants' initiaf proposal when revised per the P{anning Commission's recommendation results in 3,261 square feet of structure or 19.2% where 15% is the maximum permitted and 4,738 square feet or 27.8% of total hardcover where 25% is permitted by code. 5) The Applicants have agreed to removal of the existing 60 square foot deck and stair on the south side of the home in order to offset the structu��:�verage and hardcover levels on the Property. 6) The proposed lakeside deck is not out of charactar witY►�te neighborhood and will meet the side, lake, and average lakeshore setbacl�s. 7) The Applicant has requested approvals ir�arder to construct an o�, upper level deck on the lake side of the home. The Applicant utlderstands and is hereby p�t on notice that the deck: a) May not be enclosed above Qr below, � b) May not be expanded in an�C��+ay without further rtructural reductions on the Property. 8) The Applicants' request to increai�the sttuGtural cov�rege, hardcover and second story additions within the side setback will not alter the essential character of the neighborhood and will result in mirurna�}negative imp�ct on adja.c�r�t propettles. 9) The Applicants'request is irt F�rmony vrti�h th�;purpose�rr�Cl intent of the ordinance. 10)The Applicants' propt�&al is car�sistent with ths comprehensive p1an; and V1f#�EREAS, t� �ity Courr�i! consud+�red this application at two meetings on Novet�;b�r 24 and a��mber 8, 2014 incfud�r� the findings and recornmendations of the Plann'r�'g Commission, r�ptuts by�#ty staff, comments by the Applicants and the public, and the effeet�afi the proposed v�r'iance��in the health, safety and welfare of the community as well as the irrrpact on properti�� in the di�inity; and VIfHfREAS, the :City Council on December 8, 2014 made the following findings with regard�the appli�ation: ` - CITY COUNCIL FINDINGS 1) This application was reviewed as Zoning File#14-3697. 2) The Property is located in the LR-1C zoning district, where 0.5 ac�es is the minimum l�t area and 100 feet is the minimum lot width. The variance to allow construt�ptt above the existing footprint of the home within the 10 foot side setback will allevi�t��practical difficulty inherent to the Property's width and not created by the Applicanf�.' ` 5) Regarding the side and rear setback variances, the Applicat�fs' request is in harmony with the purpose and intent of the ordina�. ' 6) Regarding the side and rear setback vari�nC�s, the;�pplicants' prz�}�r>sal is consistent with the comprehensive plan. 7) The City Council finds that the �ttndi�fems existing t�:this Property are peculiar to it and da not apply generally to other properE3r tn this zonirrg:district; that granting the setback variances for the 2"d story additian over th� �arage wpu� not adversely affect traffic conditions, light, air nor pose a fire h�ard or othex dangerfir� �eighboring property; wauld not merely serve es a cc�enience �Ga ;the �#pp�icenfi�; buf�s necessary to alleviate a practical difficu�tyF i� neces�t�y to pres�rd���ubstanti�F�roperty right of the Applicants; and would be in k�e�ping with#t�e spirit anc�i�tent of the Zoning Code and Comprehensive Plan of the City. 8} With regar�s'#a the prt�pQ�ed deck, Rosolut�in No. 4640, adopted in 2001, granted v�irf�nces to the t�raperty r��arding the B #oot side setback for the garage, the side setb�ick variance albuvtng the�+�cond story and permitted 2,961 square feet (17.4% as adju�4ed based on currsnt lat a��� cafculations) of structural coverage. The approval allowec�ftx the Property:t� continu� � exceed the 15% structural limitation; however an increase i�r 9tructural cove��qe was not approved at that time. 9) As part of the a�+roval gr��i�d via Resolution No. 4640 a 750 square foot lakeside deck was removed and a 196 square foot screen porch was constructed in its place. 10)Granting of a variance for the proposed deck to permit additional structural coverage or massing on this Property above the allowed 15% and approved level of 17.4% is inconsistent with the goals and policies contained within the 2000-2030 Orono Community Management Plan. Page 4 of 7 ' � l�em»ll-CC Agenda-11�08 101-1 ' File^I-f-3697('Ibtal Puges 1/-/J � 11)The additional massing resulting from the proposed structuraf lakeside deck may alter the essential chara�ter of the neighborhood and would be inconsistent with the intent of the zoning code. 12)With regards ta the proposed deck, the City Council finds that granting the structural coverage and hardcover variances for proposed deck would merely serve as a convenience to the Applicants, and that no practicaL�ieulty exists to support these variances; approval of these variances is not neEa���ary to preserve a substantial property right of the Applicants; and approval of th��'iances would not be in keeping with the spirit and intent of the Zoning Code and �rrtpreh�r�sive Plan of the City.
