The righcs of individual oo whom the data is stored or to be stored shall be as set forth in this secdon. Subd.2. Information required to be given individual. An individual asked[o supply private or confidenaal data concerning himself shall be informed of: (a)the purpose and incended use of the requesced data wichin the collecting'state agency,polidcal subdivision,or statewide system; (b)whether he may refuse oY is legally required to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply privace or confidential data;and(d)the identiry of other persons or entides authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to suppiy invesdeadve dara, pursuanc to secdon 13.82, subdivision 5, to a law enforcement officer. The commissioner of re�enue mav place the norice reauired under this subdivision in the individual income tax or propertv tax refund instructions instead of on those forms. Subd. 3. Access to data by individuai. Upon request to a responsible authority,an individual shall be informed whether he is the subject of stored data on individuals, and whecher it is classified as public, private or confidendal. Upon his further request,an individual who is the subject of stored private or public data on individuals shall be shown the data wi�hout any charge to him and, if he desires, shall be informed of the contenc and meaning of that data. After an individual has been shown the private data and informed of iu meaning,che data need not be disclosed to him for six months thereaRer unless a dispute or acrion pursuanc co this secdon is pending or addidonal data on the individuai has been collected or created. The responsible authoriry shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authoriry may require the requesting person ro pay the actual cosu of makine, cerdfying, and compiling the copies. The responsible authoriry shall comply immediately, if possible, wich any request made pursuant to this subdivision,or within five days of the date of the request,exciuding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data concerning himself. To exercise this right,an individuat shall notify in writing the responsible authoriry describing the nature of the disagreement. The responsible authoriry shall within 30 days either. (a)correct the data found to be inaccurate or incomplete and attempt to nodfy past recipiencs of inaccurate or incomplete data, including recipients named by the individual; or(b)notify the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determination of the responsible authoriry may be appealed pursuant to the provisions of the administradve procedure act relacing to contested cases. If more than 50 percent of the square footage of a house is torn down or razed, the ori�inal house is de�med to no longer e�cist, and any subsequent improvements made to the remaining structure are considered to constitute the construction of a new house. There is a limit to the dollar value of the improvement which may be exempted. The limit depends on the a�e of th� property. Houses that are less than 35 years of a;e do not qualify. Houses that are at least 35 years of ape but less than 70 years are limited to one-hatf of the value of the improvement up to a ma�imum esernption of�2�,000. Houses that are 70 years of age or older are eli�ible to have the total value of any improvements exempted up to a maYimum of 5�0,000. This can be largely attributed to three factors: • Often times, improvements made to a house, particularly an older house, constitute routine maintenance.and do not cause the valuation to increase. Reshingling a roof, painting the house, repairing a foundation, replacing a plumbing fixture are all examples of improvements that would not ordinarily result in a value increase. • Improvements made to an individual's home often times reflect that particular individual's personal likes or interesu and most times the cost cannot be recovered when a proper[y is sold. Adding a sauna, a greenhouse or an indoor swimmin� pool would all be e�mples of improvements that typically add less value than their cost. • Improvements made to different areas of a house typicall}�result in greater or lesser returns. It is a well established appra.isal principal that remodeling or improving a house's service areas (kitchen, laundry and bathroom)�vill generalIy yield the greatest return to the ow-ner. Expenditures such as finishing basements or attics �vill �eneraily produce the smallest retum. Although these considerations may vary from house to house and market to market, in almost no instance is it possible to receive a dollar for dollar return ben��een cost and value added to the house. ° _;:SAL�OR TRAi�SFER 0�O���tERSHIP OF PRQPERTI' ` : ..... ......... ...:...... , . .::.. ..:.:... .... Under the law, a property owner must disclose to prospective buyers whether any improvements made to a home are ezempt from the property tax. Additionally�, sellers are also required to notify buyers that the exemption will terminate when the property is sold. If you sell your property, only improvements made b��the buyer after the closing date of the sale are eligible for the esemption. If the property loses its homestead status the esemption ezpires as of the ne�t assessment date. If the name of one of the owners of the property is removed from the title to the property as a result of a separation or divorce, or if a name is added to the tit►e of the property as a result of a marriage, the improvements continue to qualifi� for the esemption. If you transfer the title to the property to someone else, but retain a life estate in and continue to recei��e the homestead classification on the property, the improvements cont:nue to qualif�� for the esemption. If you transfer title to a related person or persons as a aift or inheritance, the exemption e�pires as of the neYt assessment date. If you do not obtain a building permit before construction begins, the improvements are not eligible for exemption. The exemption may be applied to no more than three separate improvements made to the house and�ara�e.
