Box 66 2750 Kelley Parkway NO Crystal Bay, MN 55323 Attention: Building Inspector Re: Water run-off from 2500 Casco Point Road On or about the evening of February 9`�', I arrived home to find my sump pump running almost continually, which it never does. The next morning, I decided to check it out and found my eastern cement block garage wall soaked from floor to ceiling, and a trail of water on the floor. Upon further inspection, I found water pouring down my rock retaining wall. The garage wall has been"Bone Dry" since Mrs. Paurus stopped directing her water downspout into my house. At that time (1998), I installed drain tile directing water toward the street and the other side toward the lake. No mare water problems and the sump never required activation. One can only conclude that the water is ance again being directed under the ground toward my house. See enclosed photo taken during installation and photo showing wet cement wall. The swale didn't work for Paurus and its not working now. Your cooperation in having this taken care of correctly would be greatly appreciated. Box 66 �' 2750 Kelley Parkway O��RONO Crystal Bay, Minnesota 55323 Attention: Building Inspector RE: Water run-off from 2500 Casco point Road As the home owner of property located at 2500 Casco Point I am responding to a letter I was copied on regarding water run off from our property sent to you from Beverly Morris. (Copy enclosed). I regret to learn that Beverly Moms continues to ha�e water run off related problems on her property. The problem is created by factors we do not control, as her property is located less then 3 feet away from the property line we share, and the natural slope of the elevation that has always existed between the two properties. Given the time of year the water issues experienced on February 9th would appear to be related to the frozen ground, combined with melting snow cover, elevation of her property, and close proximity to the common lot line rather then the construction of our home. The daughter of Beverly Morris directed these same concerns regarding water run off to the former owners of the property and city authorities in the past, and repeated them again to us and city ofFcials soon after we purchased the property in September 2007. Her concerns with water run off were shared with our contractor and with the city planning commission and are a matter of public record. We brought her concerns forward when we applied for a variance to build on the property and once again when we pursued our permit to build. We did not pursue a variance through the planning commission. We withdrew the request when we submitted the plans for the complying home that now resides on the property when we obtained the required permits to build. � Our home represents the full 10 foot easement required between the shared property line. The hard cover that the house occupies complies with the <25%requirement, and reduced the hardcover of the previous structure that existed on the property by> 6%. The majority of our roof line is pitched to allow water to exit the front or rear of the house away from the Moms home. There are no gutter systems installed on the home or any excess water run off directed toward her property from ours. The final inspection approving occupancy for our home was signed on August 2"d. No alterations or changes of any type have taken place since that final inspection. You may recall in addition to yourself, Tom Kellog, John Vogustrom, Eric Vogstrum and I viewed the area closely to insure that a swell was properly installed draining the incidental water run off from the side of our home adjacent to the Morris property. The swell was installed to direct any excess water to the back or front of our property. Photographs taken of the previous residence located on the property clearly illustrate that a new significant swell has been installed. The city has and can re-inspect this swell at any time to insure no alterations have taken place. We installed a sod lawn immediately to further reduce any significant run off. The photos attached to the letter that was sent in by Ms. Morris (copy enclosed)display a perforated drain to capture incidental run off from the small section of roof line that is pitched toward her property and was approved by Tom Kellog. This `dry day light drain' was installed on the day of the inspection on August 2°d to further slow run off coming from the roof. This drain is located several feet north of the Morris garage and exits into the swell which flows north away from her home and garage. The photo they took in August of the drain and letter sent is just one of many inconsistent statements and claims that I have had to address since purchasing the property adjacent to hers. We were told by Ms Morris's daughter on two separate occasions that there home has never been so dry and that she appreciated what our builder did to prevent water going towards their home. Ms. Morris while complaining about the incidental water run off from our property does not reference the gutter from her home which drains her entire roof and is directed to empty onto our property. My backyard is frequently soggy for several days following rain fa1L I have not brought this to her attention previously being sympathetic to her on going water problems. As stated earlier soon after we purchased the property and met with Ms Morris's daughter we were told by her daughter that she had water issues. She also referenced a retaining wall that was in disrepair due to age and requested we take caution to insure no further damage was done. Ms Morris claimed afterwards construction equipment damaged her retaining wall further. To appease Ms Morris we had her retaining wall completely repaired at our expense even though it was clear the decline of the wall was a result of the age and decaying condition of the materials. This retaining wall is now in much better condition than it was when we purchased our property thanks to us. I have been respectful in addressing the various concerns the Morris's have brought to our attention. Unfortunately her issues ha�e been, and continue to result from the close proximity her home resides to the property line and the topography of the land in reference to the adjacent property that has existed since her house was built. The next morning, I decided to check it out and found my eastern cement block garage wall soaked from floor to ceiling, and a trail of water on the floor. Upon fiu�ther inspection, I found water pouring down my rock retaining wall. The garage wall has been`Bone Dry"since Mrs. Paurus stopped directing her water downspout into my house. At that time (1998), I installed drain tile directing water towazd the street and the other side toward the lake. No more water problems and the sump never required activation. One can only conclude that the water is once again being directed under the ground toward my house. See enclosed photo taken during installation and photo showing wet cement wall. The corner of my garage is 7.05' from the property line per my survey, not 3 feet. 2. The main drain from my roof is on the north side of the house, not on the Vanacora east side. Furthermore, their large red excavation machinery and other heavy equipment were routinely operating on my properiy precariously close to my house; which disturbed the soil, contributing to the drainage problem. Vanacoras were shown these tracks as evidence of these operations. Your assistance in conecting the drainage problem will be greatly appreciated. Hawkins Landscaping crew did not have survey of the property; at least they ciaimed they did not have. They crossed property line all the time and deposited earth beyond property and destroyed planting. They said they did not have room to maneuver around and they refused to put a red fence to mark the boundaries. When owners tried to put some stakes, these marks were knocked down. I have called Orono City Hall and Vogue to discuss these problems several times. Fortunately our home is far enough from construction site but we were watching as heavy excavators were working frighteningly close to Mrs. Morris house. Regards, Natalya Chernevskaya
