Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subd.I. Type of data The rights of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Information required to be given�ndividual.An individual asked to supply privaze or confidential data conceming himself shal l be
informed of: (a)the purpose and intended use of the requested data�vithin the collecting state agency,political subdivision,or stateHride system(b)
whether he may refuse or is legally required to supply the requested data;(c)any i:now�n consequence azising from his supplying or refusing to supply
private or confidentiai data;and(d)the identity of other persons or entities authorizeci by state or federal law to receive the data This requirement shall
not apply when an individual is azked to supply investigative data,pursuant to section 13.82,su6division 5,to a law enforcement officer.
The commissioner of revenue mav place the notice reauired under this subdivision in the individual income ta�c or nronem tax refund
instructions instead of on those forms.
Subd.3. Access to data by individual. Upon request to a responsible authority,an individuai shal I be informed whether he is the subject of
stored data on individuals,and whether it is dassified as public,private or confidential. Upon ttis further request,an individual who is the subject of
stored private or public data on individuals shall be shown t6e data without any charge to him and,if he desires,shall be informed of the content and
meaning of that data. After an individual has been shown the private data and infom�ed of its meaning,the data need not be disclosed to him for six
months thereafter unless a dispute or action pursuant to this secrion is pending or additional data on the individual has been collected or created. The
responsible authoriry shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority
may require the requesting person to pay the actual costs of making,certifying,and compiling the copies.
T'he responsible authority shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days of
thedateoftherequest,excludingSaturdays,Sundaysandlegalholi�ys,ifimmed�ecomplianceisnotpossible.[fhecannotcomplywiththerequest
within that time,he shall so inform the individual,and may have an additional five days within which to comply with the request,excluding Saturdays,
Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete.An individual may contest the accumcy or completeness of public or private data
conceming himself. To exercise this right,an ir�dividual shall notify in writing the re�onsible authority describing the naYure of the disagreement The
responsible authority shall within 30 days either. (a)comect the data found to be inaccurate or incomplete and attempt to notify past recipients of
inaccurate or incomplete data,including recipienu named by the individual;or(b)notify the individual that he believes the data to be correct. Data in
dispute shall be disclosed only if the individual's statement ofdisagreement is induded with the disctosed data.
The detertnination of the responsible authority may be appealed pursuant to the provisions of the administrative procedure act relating to
contested cases.

We have reviewed the grading plans for 2500 Casco Point Road dated 1-24-08. The plans propose to
construct a new single family home, We have the following comments with regards to engineering matters:
• At the southeast corner of the home, Instead of directing drainage over the proposed retaining
wall, we recommend that a small drainage structure be placed in the area above the wall. The
pipe could be daylighted between the proposed retaining walls near the 18" cottonwood tree.
This pipe could also be connected to the roof drain at the southeast corner of the house
• The drainage arrows between the 18" cottonwood and 2-10" maple trees near the southeast
retaining walls should be reversed to avoid any confusion during construction. With the top of the
wall at 945.0, this area should drain to the south or southeast away from the wall.
• The City shoultl consider requiring that the applicant pave the access drive from the driveway to
Casco Point Road.

Please review the attached grading plan for a replacement residence. You previously
reviewed a grading plan for this property as zoning application 07-3331. That
application has been withdrawn.
The driveway apron has the same problem as the previous plan. Before I have them
fix I would like your review so they can fix the grading at the same time.
The portion of the driveway that is off the property is in a private road outlot. They are
the only users. The code would require the portion of the driveway that drains to the
street to be paved. Of course this isn't enforced, but with the reconstruction of the
road happening soon, should it be in this situation?

The grading plan was sent to Bonestroo on Friday, February 1. When I get the review
I will email it to you and the surveyor.
The driveway does not conform to the minimum requirement. Attached is a spec.
sheet. It will require more hardcover so some adjustments will need to be made.
Parker forgot the hardcover calc sheet for the 250 to 500 foot zone. Be sure he
provides it with the revised survey.
