Re: Work on Boat house without Building Permit
Dear Mr. Cannistraci:
The City of Orono has been dealing with zoning issues relating to the boathouse on your property
dating back to 1971. Over the years the structure has been worked on many times without building
permits or City approval. You seem to be carrying on the tradition. The building had a stop work
order posted on it prior to your purchase of the property. Another stop work order was posted 2
weeks ago when a contractor was preparing to replace the rear wall of the foundation. When I
returned on August 11, 1999,the foundation work was done. I also noted that the deck was replaced
and work was being done inside the building.
Work without a building pernut and working on a structure within 75' feet of the lake is a violation
of Orono Municipal Code. The City would like to meet with you to discuss bringing the property
� into conformance. Lega1 action may be initiated if the issues cannot be resolved. Please contact me

Dear Mr. Oman:
I received y�ur letter dated August 16, 1999 regarding "Work on Boat House without Building
Permit." I read this letter with surprise. You made reference to a stop work order posted on the
property prior to my purchase. There was no such posting on the structure at the time I took
possession of the property, and I have no knowledge of any subsequent notice. This is the first
communication I have had with the City of Orono regarding this issue. In addition, I am deeply
troubled by your comments implying any association between me and previous owners of this
property. I have no knowledge nor do I need or wish to have knowledge of the activities/
relationship of previous owners of this property with the City of Orono.
There has been no new construction made to this structure. In order to protect my substantial
investment in this property, maintenance and repairs have been made to the existing structure. I
was unaware and surprised that such repairs require prior city approval. Of course I am willing to
work with the City of Orono to resolve this issue.
You mention in your letter that you would like to meet to discuss this issue. This is acceptable to
me. However, due to my travel schedule I will be unable to meet until after Labor Day,
September 7th. If a meeting at your office is still required, please call me after September 7th to
schedule this meeting. It would be best if you left a message on my answering machine with a
minimum of two days and two different times that you are available (first thing in the morning

both our schedules.
So that I am fully informed of my rights as a property owner in the state of Minnesota, I request
that prior to any such meeting you provide me with a copy of the official state and municipal
codes and/or statutes that specify in sufficient details the exact repair and maintenance activities a
homeowner in the City of Orono can and cannot perform without obtaining a building permit.
I look forward to speaking with you and the expedient resolution to this matter.

RE: WORK ON BOAT HOUSE WITHOUT PERMIT �
Dear Mr. Cannistraci:
We have received your letter requesting information regarding the repair of a boat house on your
property. The only building permit on record for the existing boat house was issued in 1971 for
construction of a single-story structure capped with deck,approximate size of the structure according
to the permit file is 20' X 30'. According to our files, no other portion of the boat house or attached
deck have had building permits issued. For any work to occur on the portions of the boathouse
w7thout a previous building permit, or to allow any major structural repairs to the foundation of the
single-story will require City Council approval.
I have included with this letter a copy of a variance application form and copies of the Municipal
Code sections relating to setbacks and non-conforming structures. Please review and contact me at
your convenience to set up an appointment to further discuss this matter.
