A RESOLUTION GRANTING A CONDITIONAL USE PERMIT PER MUNICIPAL ZONING CODE SECTIONS 78-1286(b) and 78-966 FILE NO. 03-2942 WHEREAS, George E. Mileusnic and Marilyn K. Mileusnic, husband and wife (hereinafter "the applicants") are the owners of the property located at��'� Casco Circle within tlte City of Orono (hereinafter the "City") and legally described as follows: Lot 15; All of the land, including the vacated highway, lying between the front or Easterly line of said Lot 15 and the shore of Lake Minnetonka, and between the Northerly and Southerly lines of said Lot 15 extended to said lake shore, and being part of Government Lot 6, Section 20, Township 117, Range 23; All in Spring Park. (hereinafter the "property"); and WHEREAS, the applicants have made application to the City of Orono for a conditional use permit per Orono Municipal Zoning Code Section 78-1286(b) and 78-966 to allow construction of a 4' retaining wall and the import of fill in order to stabilize a 2:1 slope within 75' of the OHWL of Lake Minnetonka. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#03-2942. 2. The property is located in the LR-1C, Single Family Lakeshore Residential District. 3. The Planning Commission reviewed this application at a public hearing held on September 1�, 200; and recommended approval of the condirional use permit based on the followin�findings: a. The eYisting 8' hi�h rz�inin��vall failed and caused a landslide on the lakeyard slope «ithin i�' of the shoreline. b. The reconstruction of a �-a11 4' or less in height and maintenance of a slope no greater than ?:1 is supported by the City's En�ineer, and is necessary to stabilize the slope and protect the slope from further damage. c. The applicants ha�-e proz-ided a restoration plan meetin� the goals and intent of the Zonin� Code and the Orono Community Mana;ement Plan. d. The Planning Commi=�ion finds that the plan should be amended to include rivo ne�v trees «-ithin the lake yard to soften the view of the restored slope. 4. The City Council has cor�idered this application including the findings and recommendation of t�e Planning Commission, reports by City staff, comments by the applicar:r� and the public, and the effect of the proposed variance on the health, saf t�-and welfare of the community. 5. The City Council finds t�at the conditions existin� on this property are peculiar to it and do not �ply generally to other property in this zoning district; that grantinQ the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merel�-serve as a convenience to the applicants, but is necessary to alleviate a de�onstrable hardship or difficulty; is necessary to preserve a substantial property ri�ht of the applicants; and would be in keeping with the spirit and i.ntent of the Zoning Code and Comprehensive Plan of the City. CO�CLUSIO�S, ORDER Al�'D CONDI�I'IONS Based upon one or more of the 4ove findings, the Orono City Council hereby grants a conditional use permit per Oro�o Municipal Zoning Code Section 78-1286(b) Pa_e 2 of 5 � o� o t�� _ o ��. CITY of ORONO � �� � � � �� �� ��� ti � � G~' RESOLUTION OF THE CITY COUNCIL ��kESH�4� NO. 3 � r= s; and 78-966 to allo�v construction of a 4' retaining wall and the import of fill in order to stabilize a 2:1 slope ��ithin 7�' of the OHWL of Lake tilinnetonka, subject to the following conditions: 1. Council approval is based on the restoration site plan submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibits A, B & C. Any amendments to the plan«-hich are not in conformity with City codes will require further Plannin� Commission and City Council review. 2. Authorities �anted by this resolution run with the property not with the applicants, but are permi�sive only and must be exercised by obtainin� a building permit for the ne�v construction�vithin one year of the date of Council approval, or the variance�vill expire on that date (September 22, 2004). 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority�anted herein, and shall be punishable as a misdemeanor. 4. The undersi�ed applicants have read, understood and hereby a;ree to the terms of this resolution and on behaif of the applicants and the applicants' heirs, successors and assi�s, hereby agree to the recordin� of this resolution in the chain of title of the property. y Adopted by the Orono City Council on the 22nd day of September, 2003.
