NO`V, THEREFORE BE IT RESOLVED by the City Council of Orono, l�linnesota: FINDI\GS 1. This application was reviewed a:Zonina File�03-29�2. 2. The property is located in the LR-1B Zoning District, w-hich requires a minimum lot size of 1 acre and a requi:ed lake yard setback of 7�'. 3. The Plannin� Commission re�-ie•,�ed this application at a public �e�-ing held on Monday, October 20. 2003 and recorrLmended appro�-al of variances based on the followin��indinas: .� a. A very small portion of the existinQ home is situated within 7�' of the OHWL of Lake 1�linnetonl:a. � c. The revisions to the roof lines «zll ha��e no impact on lake views enjoyed by neiQhboring property o«�ners. d. Although the proposed construction does not add hardcover to the property, the site already contains hardco��er in the 75'-250' zone in excess of the allowed 2�°ro and the applicant has ajreed to remove certain hazdcover items to result in a reduction from 58.6% to 53.2%. 4. The City Council has considered this application including the findings and recommendation of the PlanninQ Commission, reports by City staff, comments b�- the applicant and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existin� on this property are peculiar to it and do not appl�� generally to other property in this zoning district; that granting the variance «-ould not ad��ersely affect traffic conditions, liaht, air nor pose a fire hazard or other dan�er to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difticulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the ZoninQ Code and Compreh�nsive Plan of the City. ` CO`CLUSIONS, ORDER�\"D CO�-DITIONS Based upon one or more oi the abo��e findinas, the Orono City Council hereby grants a variance to Orono Liunicipal ZoninQ Code Section 78-281 Subdivision (b), 78- 350 Subdivision (b), 78-1279 Subdivision (b) and 78-1288 to allo��� reorientation, change in pitch and addition of dormers to the roof of the e�isting home «-hich is completely within the average lakeshore setback, and partiall�• ��-ithin 7�' of the OHWL of Lake 1�linnetonka, subject to the followin� conditions: 1. Council approval is based on the site plan submired b�- the applicant and annotated by City staff: attached to this Resolution as Eshibit A. Any amendments to the site plan which are not in conformity «-ith City codes wrill require further Plannina Commission and Cit�- Council revie«�. Hardcover in the 0-75' zone shall not i�crease above the 55 sf. or 0.6%. Hardcover in the 7�-250' zone shall be L�ited to 5505 s.f. or 53.2% per the proposed plan and hardcover allowance _.:mmary as depicted on Exhibit A. Applicant is advised that any future reque�� to increase hardcover or chanQe the nature of existin��approved hardcover shaL require City approval, and increases in hardcover will not likely be approved «�-Wout concunent reduction in existing hardcover. 3. Applicant shall remove all plastic or fabr� liner material from the decorative landscape beds on the property to ensure :heir permeability as non-hardcover surfaces. 4. Required removals of structure and hardc���.-er shall be completed by the first framing inspection. 5. Authorities granted by this resolution run «:-::the property not with the applicant, but are permissive only and must be exerci:.3 by obtainin; a building pernut for the new construction within one year of �e date of Council approval, or the variance will expire on that date (October 2-. �00-�). 6. Violation of or non-compliance with an�� ci the terms and conditions of this resolution shall constitute a violation of t:: zonin� code, shall automatically terminate any authority granted herein, and _�all be punishable as a misdemeanor. 7. The undersi�ed applicant has read, understcod and hereby a�rees to the terms of this resolution and on behalf of the applic�r: and the applicant's heirs, successors and assi�s, hereby agrees to the recordina cf this resolution in the chain of title of the property.
