3225 Casco Circle
On January 8, 2014 the City received a building permit application for a new single family home at 3225 Casco
Circle. Your application is incomplete. The following items must be submitted or revised in order for your
application to be considered complete and for the plan review to continue:
1. Certificate of Survey. City Engineer, Jesse Struve, reviewed the survey and has the following
comments:
a. I sent an email to Sven on 12/30/13 allowing a horse shoe driveway, the widths within the right of
way needed to be 10'. The survey shows driveways widths exceeding 20'. In an effort to be
somewhat reasonable, I will allow for a 2' radius at the side of each driveway. The current
driveway configuration has very large, sweeping radiuses on the sides of the driveways. This
must be revised.
b. Are there any steps down to the existing boat house? How is this accessed? Please clarify on
the survey.
c. The survey should show more pronounced drainage swales on either side of the house.
Please provide two copies of an updated, full size certificate of survey which addresses the above
comments and meets all of the City's survey standards (enclosed) including, but not limited to identifying
the proposed top of foundation elevation.
2. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District.
Although hardcover calculations were prepared, they are shown on the survey and not on the City's
hardcover calculation forms. Please have the surveyor prepare hardcover calculations, showing existing
and proposed hardcover using the City's forms. Attached is a copy of our hardcover information packet.
3. Zoning Disclosure Form. Please have the property owners sign the attached Zoning Disclosure Form
and return it to us.
4. Permits. A demolition permit and a sewer disconnect permit are also required. Copies are attached.
5. Escrow 8� Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and
stormwater. The required escrow amount for this project is $2,500. The escrow agreement is enclosed.
The property owner must sign the escrow agreement and submit a check for$2,500.

We received a reduced copy of an as-built survey for 3325 Casco Circle, we will need a full-size copy submitted for our
review. After a cursory review of the survey, improvements are shown within the 75' zone that were not approved with
the proposed survey—stairs, fire pit area and retaining wall. Please submit documentation showing they were pre-
existing or they must be removed.
The hardcover calculations are shown on the survey,we don't foresee a problem with the hardcover, but please but
have the surveyor show the existing calculations on our hardcover calculations worksheet for the most accurate
information. Attached is a copy of our hardcover information packet which includes the hardcover calculation
worksheet.
A temporary certificate of occupancy escrow agreement is attached. Please have the property owners sign the attached
agreement and return with a check for$7,500. This will be combined with the $2,500 currently held by the City for a
total of$10,000 until the above information is received and the as-built survey can be reviewed in the Spring.

ESCROW AGREEMENT

AGREEMENT made this day of , 20 , by and between the CITY OF
ORONO, a Minnesota municipal corporation ("City") and Martin & Kathryn Leestma ("Owners").
Recitals
1. Construction of the new residence located at 3225 Casco Circle the ("Subject Property"),
legally described as All that part of Lot 28, Spring Park, lying westerly of a line described as
follows: Commencing at a point on the northerly line of said Lot 28, distant 45.5 feet
southwesterly, measured along said northerly line from the northeasterly corner of said Lot 28
which corner is marked by a judicial landmark; thence southerly along a straight line to the
shore of Lake Minnetonka, said straight line passing through a point, marked by a judicial
landmark, which is 9 feet westerly, measured at right ang/es, with the easterly line of said Lot
28, from a point in said easte�ly line of said Lot 28, distant 262.5 feet southerly from the
northeasterly corner of said Lot 28; also all of Lots 29 and 30, together with and including that
part of Lake Shore Avenue, vacated, lying in said Lots 29 and 30 and in that part of said Lot
28 hereinbefore described, all in Spring Park, according to the plat thereof on file and of
record in the office of the Registrer of Deeds in and for Hennepin County, Minnesota, and the
Northwesterly corner of Lot 30 having been marked with a judicial landmark, and further
judicial land mark having been /ocated on the westerly line of Lot 30 at a point which is 249.2
feet southerly from the northwesterly corner thereof in Orono, Hennepin County Minnesota,
is the subject of building permit application number 2014-00025 has been completed.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2014-00025 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners' receipt of bill.

4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when all requirements related to the project are complete. City Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have
been successfully completed and whether it is appropriate to return the funds. Owner may also request
the release of the funds, and such funds shall be released upon City Staff receiving the appropriate
verification that all requirements of the project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvements, final grading, establishment of vegetation and
the restoration of the subject property should the Owners not complete the work by the specified dates.
