RESOLUTION OF THE CITY COUNCIL
No. 569
A RESOLUTION
APPROVING TRE PLAT OF
CRYSTAL BAY BUSINES& CENTER
FILE NO. 07-3310
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono (hereinafter "City Council")
has adopted subdivision and land development regulations for the orderly, economic and safe
development. of land within the City; and
WHEREAS, the City Council has considered the application by Ryan Companies
US, Inc. (a Minnesota corporation), hereinafter the "Subdivider", for subdivision of property
located at 430/450 Old Crystal Bay Road North and 2725/2765 Wayzata Boulevard and legally
described as Lots 1, 2, 3 and 4 Block 1 Van Dale Addition, Hennepin County, Minnesota
(hereinafter -"the Property"); and
WHEREAS, on September 11, 2006 the City Council adopted�Resolution No.5504
granting Preliminary Plat Approval for the proposed development of a four lot plat for industrial
purposes; and
WHEREAS, on September 10, 2007 the City Council adopted Resolution No.5654
extending the Preliminary Plat Approval for one year; and
WHEREAS., the Subdivider has completed some of the requirements of the
platting regulations of the City including:
1. Dedication on the plat of Orono Industrial Boulevard, perimeter Drainage and Utility
Easements, and Utility Easements for existing water main.
2. Payment to the City of final plat review fees and legal review and filing fees.
3. Providing the City a title opinion for the Property and certified copies of all recorded
easements currently affecting the Property.

4. Obtaining a stormwater plan approval and permit from the Minnehaha Creek Watershed
District.
WHEREAS, the Subdivider has agreed to complete all other requirements of the
platting regulations of the City including:
1. Entering into the Development Agreement.
2. Providing securities for the Public and Private improvements as called for in the
Development Agreement.
3. Completion of all platting requirements and those of Resolution No. 5504.
4. Payment of a Park dedication Fee of $60,000.00.
5. Payment of a Storm water and drainage trunk fee of $128,.100.00
NOW, THEREFORE, BE IT RESOLVED that based on the findings of
Resolution No. 5504, the City Council of the City of Orono does hereby approve the plat of
Crystal Bay Business Center, Hennepin County, Minnesota, a copy of which is attached as
Exhibit A, subject to the following conditions:
1. The City Clerk shall release the plat documents for filing only upon certification by the City
Attorney, Planning and Zoning Coordinator and City Engineer that all requirements of the
platting regulations have been satisfied.
2. The aforesaid plat shall be filed with Hennepin County on or before May 1, 2008, together
with a certified original copy of this resolution and executed copies of the easements and
covenants pertinent thereto.
The approval granted by this Resolution shall expire if the conditions of this
Resolution have not been met or the plat has not been fled by the date specified above. In that
event, it will be necessary to filea new application with the City of Orono for subdivision review.
