HomeMy WebLinkAboutResolution 5673RESOLUTION OF THE CITY COUNCIL NO 567; A RESOLUTION APPROVING AMENDMENT #5 OF THE 2000-2020 CITY OF ORONO COMMUNITY MANAGEMENT PLAN WHEREAS, the City of Orono is a municipal corporation located within Hennepin County and within the planning jurisdiction of the Metropolitan Council; and WHEREAS, in accordance with the Metropolitan Land Planning Act of 1976 and its amendments, and with Minnesota Statutes Chapters 462 and 473, the City of Orono in November 2001 adopted a comprehensive municipal plan known as the 2000-2020 City of Orono Community Management Plan (also referred to as the 2000-2020 CMP) to provide for the orderly development of the City; and WHEREAS, an integral element of the 2000-2020 CMP is the Comprehensive Sewer Policy Plan, which identifies certain areas of the City as being within the Metropolitan Urban Service Area (MUSA) in which connections to the metropolitan sanitary sewer system are allowed; and WHEREAS, the neighborhood within the City of Orono known as "Myrtlewood" is comprised of 10 single family residential homes developed from 1954 to 1967 using septic systems and wells, on lots ranging in size from less than 1 acre to just more than 7 acres in gross area; and WHEREAS, Myrtlewood is zoned RR -1B, Single Family Rural Residential District, requiring a minimum lot size of two dry buildable acres. Only three of the ten developed lots meet the 2 -acre standard, and four of ten contain less than one acre of dry buildable land. None of the existing lots are further subdividable under current zoning; i.e. none of the larger lots contains as much as 4.0 acres of dry buildable land; and WHEREAS, through its ongoing program of inspection of existing septic systems, the City has determined that 6 of the 10 developed lots have non -conforming septic systems that are required to be repaired or replaced by December 31, 2010 in accordance with City ordinances; and WHEREAS, a majority of the lots have limited available area for septic system replacement or expansion, due to a variety of factors including the proximity of wetlands, steep Page 1 of 3 , �v OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 5673 slopes, lot size, shape and layout. Orono requires that each new home site have the capability for two 5 -bedroom capacity ISTS systems meeting all current codes. This requirement was not in effect at the time the Myrtlewood area was developed. Most of the Myrtlewood homes with newer replacement septic systems have already used any alternate site that may have been available, and do not have the possibility of an alternate site for future use. Of the 6 homeowners that have a 2010 deadline in which to update their older nonconforming systems, a majority will find it difficult (and in some cases impossible) to find a suitable replacement location, much less a future alternate site; and WHEREAS, in light of the above noted facts the Orono Planning Commission pursuant to published and written notice to the affected and surrounding property owners held a public hearing on February 22, 2005 and on a vote of 5-0 recommended that the Myrtlewood neighborhood be added to the MUSA; and WHEREAS, the Orono City Council on February 28, 2005 voted 5-0 to conditionally approve an amendment of the 2000-2020 Community Management Plan (CMP) to include the Myrtlewood neighborhood in the Metropolitan Urban Service Area subject to Metropolitan Council review and approval, and directed City staff to prepare such an amendment and submit it to the Metropolitan Council for review and approval; and WHEREAS, on May 19, 2005 documentation for the proposed amendment was submitted to the Metropolitan Council for review and approval, and written notice was sent to neighboring cities and other potentially affected governmental jurisdictions, requesting written comment; and WHEREAS, additional supportive information was submitted to the Metropolitan Council on June 18, 2007; and WHEREAS, on September 13, 2U07 the Metropolitan Council indicated to the City via letter that the 2000-2020 CMP Amendment 45 - Myrtlewood Area MUSA is in conformance with regional system plans for transportation and parks, is consistent with the 2030 Regional Development Framework and Council policies, and is compatible with the plans of adjacent jurisdictions. The letter indicated that the City may place the amendment into effect with no modifications, subject to the condition that Orono is required to participate in the Met Council's plat monitoring program and to submit annual reports; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orono hereby amends the 2000-2020 City of Orono Community Management Plan Part 4C, Comprehensive Sewer Policy Plan (CBPP) by incorporating into the MUSA the Myrtlewood Page 2 of 3 CITYOF ORONO RESOLUTION OF THE CITY COUNCIL NO 5673 neighborhood area described in attached Exhibit A, subject to the conditions established by Met Council for participation in the Plat Monitoring Program, finding that: 1. The amendment meets the intent of the basic goals, objectives and policies set forth in the 2000-2020 CMP. 2. The amendment is consistent with the goals, objectives, needs and desires of Orono residents. 3. The amendment is consistent with the planning goals and objectives of Orono's municipal neighbors. FURTHER BE IT RESOLVED that Map 4C-2 shall be revised to reflect the Myrtlewood neighborhood area as Part XXXXV of the Orono MUSA.
