RESOLUTION OF THE CITY COUNCIL
NO. 5650
A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 78-395, 78-1434 & 78-1435
FILE NO. 07-3304
WHEREAS, Christopher J. Hedberg and Heidi H. Hedberg, husband and wife
(hereinafter "the Applicants") are the owners of the property located at 3940 Watertown Road
within the City of Orono (hereinafter the "City") and legally described as follows:
Attached as Exhibit A, (hereinafter the "Property"); and
WHEREAS, the applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-395 to allow the existing barn to be
setback 39.6 feet from the side lot line where a 50 foot setback is normally required, and 95.2
feet from the front lot line where a 100 foot setback is normally required; and
WHEREAS, the applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1434 to allow the existing 3,000 square
foot barn where an oversized accessory building with a maximum square footage of 2,600 s.f. is
normally permitted on a property of this size; and
WHEREAS, the applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1435 to allow the existing barn to be
located at 95.2 feet from the front lot line, slightly ahead of the proposed principal structure,
where at least 100 feet and behind the principal structure is the setback normally required for an
accessory structure.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
This application was reviewed as Zoning File 07-3304.
2. The property is located in the RR -IA, Rural Residential Zoning District which
requires a minimum lot area of 5.0 acre and a minimum lot width of 300'.

The Planning Commission reviewed this application at a public hearing held on
July 16, 2007 and recommended approval of variances based on the following
findings:
a. The Property contains 337,316 s.f, or 7.74 acres in area and has a total of 545
feet in width, 33' from the centerline of Watertown Road.
b. The lot exceeds the zoning district requirement for area and width and the
existing barn and farm residence has existed on the property for many years.
c. The setback variance as requested will not negatively impact views of the
Property.
d. The applicants have agreed, as part of this resolution, to enter into a covenant
that disallows use of the barn for a home occupation, dwelling, or rental/lease
of the building as a dwelling.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variances would not adversely affect traffic conditions, light, air nor pose a
fire hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but are necessary to alleviate a demonstrable
hardship or difficulty; are necessary to preserve a substantial property right of the
Applicants; and would be in keeping with the spirit and intent of the Zoning Code
and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants z
variance to Orono Municipal Zoning Code Section 78-395 to allow the existing barn to be
setback 39.6 feet from the side lot line where a 50 foot setback is normally required, and 95.2
feet from the front lot line where a 100 foot setback is normally required; a variance to Orono
Municipal Zoning Code Section 78-1434 to allow the existing 3,000 square foot barn where an
oversized accessory building with a maximum square footage of 2,600 s.f. is normally permitted;

and a variance to Orono Municipal Zoning Code Section 78-1435 to allow the existing barn to be
located at 95.2 feet from the front lot line, slightly ahead of the proposed principal structure,
where at least 100 feet and behind the principal structure is the setback normally required for an
accessory structure to allow the existing barn to remain as it is, in size and location, subject to the
following conditions:
1. Council approval is based on the site plan submitted by the applicants and annotated by
City staff, attached to this Resolution as Exhibit B. Any amendments to the site plan
which are not in conformity with City codes will require further Planning Commission
and City Council review.
2. Authorities granted by this resolution run with the property not with the Applicants, but
are permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire
on that date (August 13, 2008).
3. The applicants hereby agree by executing this resolution and covenant that the accessory
building that is the subject of this resolution will not be:
a. Used for a home occupation unless specifically approved by the City or if allowed
by this Code.
b. Used as a dwelling unless a guest house conditional use pen -nit is obtained.
c. Rented, leased or otherwise provided for use as a dwelling under any
circumstances.
The applicants acknowledge that this covenant shall be binding upon current and future
owners of the Property, and shall be filed within the chain of title of the Property.
4. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of the
property.
