TRANSFER ENTERED FIBlMEM OOUNrtr TAXMyM SgRO ce DEC 01 2011 I/i A RESOLUTION GRANTING SUBDIVISION OF A LOT LINE REARRANGEMENT FOR PROPERTIES LOCATED AT 290 & 315 WOODHILL ROAD FILE NO. 07-3300 CITY of ORONO RESOLUTION Of THE CITY COUNCIL A RESOLUTION GRANTING SUBDIVISION OF A LOT LINE REARRANGEMENT FOR PROPERTIES LOCATED AT 290 & 315 WOODHILL ROAD FILE NO. 07-3300 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of Orono (hereinafter "City Council') has adopted subdivision regulations for the orderly, economic, and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision of a lot line rearrangement by John C. O'Malley and Lois A. O'Malley, husband and wife; and William W. McGuire and Nadine M. McGuire, husband and wife (hereinafter collectively referred to as the "Applicants"); for properties legally described as: Attached as Exhibit A (hereinafter "the Properties"); and WHEREAS, the Properties consist of three separate parcels owned by the Applicants as shown on the survey attached hereto as Exhibit B; and WHEREAS, the Applicants have submitted an application for Class I subdivision for a lot line rearrangement consisting of the following: Separation of Parcel 3 from Parcel 2 and a combination of Parcel 3 with Parcel 1 as shown in Exhibit C; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono Planning Commission held a public hearing on July 16, 2007, at which time ail persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the Applicants have completed or have agreed to complete all requirements of the City for a subdivision of a lot line rearrangement for division and combination purposes, resulting in the relocation of the common lot boundaries between Page 1 of 5 X `0 CITY of ORONO s G~� RESOLUTION OF THE CIT COUNCIL \$EgfiO4� NO. Q the Properties, as shown in the survey attached as Exhibit C, and resulting in new legal descriptions for each as shown in Exhibit D; and WHEREAS, at their regular meeting held on August 13, 2007, the Orono City Council considered the proposed subdivision of a lot line rearrangement, noting the following findings of fact: The Properties are located within the RR -1B, One Family Rural Residential Zoning District requiring a minimum of 200 feet in lot width and 2.0 acres of contiguous dry buildable land within each newly created lot. 2. The proposed lot line rearrangement encompasses two residential lots and one Outlot, containing a total of 10.75 acres of land. Upon completion of the lot line rearrangement, 290 Woodhill Road will contain 2.0 acres and over 200 feet in defined width which will continue to be conforming with respect to lot area and lot width within the RR -113, One Family Rural Residential Zoning District. 4. Upon completion of the lot line rearrangement, 315 Woodhill Road will contain approximately 8.75 acres and over 200 feet in defined width which will continue to be conforming with respect to lot area and lot width within the RR -1B, One Family Rural Residential Zoning District. Because the subdivision is not creating a new buildable site, no park fees will be due. Additionally, the properties are not subject to Storm Water and Drainage Trunk Fees. 6. The lot line rearrangement results in no setback deficiencies for the existing structures on the Properties. At the time that the subdivision of Woodhill Ridge Second Addition was created, Parcel 2 and Parcel 3 were bound by a "Special Lot Combination Agreement' establishing that they shall remain in common ownership in perpetuity, because of their proximity and the lack of an appropriate abutting property for attachment of Parcel 3. The proposed lot line rearrangement now allows for a detachment and recombination involving the abutting parcels. Page 2 of 5 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5648 FURTHER BE IT RESOLVED, that the Council of the City of Orono hereby approves the lot line rearrangement of the Properties as shown on the certificate of survey by Mark S. Gronberg, dated May 29, 2007, as attached in Exhibit C, subject to the following conditions and declarations: 1. Prior to release of this resolution for filing, the Applicants shall provide a title opinion for the Properties confirming ownership and encumbrances, to the satisfaction of the City Attorney. 2. The aforesaid division shown on the attached Certificate of Survey shall be filed by the City of Orono with the Hennepin County Registrar of Titles Office on or before January 13, 2008 together with a certified copy of this resolution. 3. 'Parcel 1 and Parcel 3 shall be legally combined. 4. The approval granted by this resolution shall expire if the division and combination has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. 5.
