A RESOLUTION
GRANTING A SECOND SIX MONTH EXTENSION
TO THE EFFECTIVE PERIOD
OF FINAL PLAT APPROVAL
ESTABLISHED PER RESOLUTION NO. 5486
AS MODIFIED PER RESOLUTION NO. 5610
- FILE NO. 05-3097/07-3282
WHEREAS, on July 10, 2006, the City Council of the City of Orono (the
"City") adopted Resolution No. 5486 granting final plat approval for subdivision of
property located at 1745 Fox Street; and
WHEREAS, City of Orono Municipal Code Section 82-146 establishes
that final plat approval is effective for six months from the date of such approval, and
failure to complete final subdivision requirements within this time period shall be
considered as formal withdrawal of the proposed subdivision; and
WHEREAS, the applicant was unable to arrange for finalization of the
required submittals within the six-month period during the fall of 2006, and now
anticipates commencement of development improvements in 2007; and
WHEREAS, the applicant was granted an extension of the effective
period of final plat approval via Resolution No. 5610 on April 23, 2007, but said
extension was only for 6 months from the initial expiration date of January 10, 2007;
and
WHEREAS, the applicant wishes to continue the development process
per the approvals granted in Resolution No. 5486; and
WHEREAS, the property owner has made application 407-3282 and
requests a further six month extension of the effective period of final plat approval to
January 10, 2008.
NOW, THEREFORE, BE IT RESOLVED by the City
Council of the City of Orono, Minnesota, as follows:

1. The effective period of final plat approval is hereby extended to
January 10, 2008; and
2. All other terns and conditions of Resolution No. 5486 as amended by
Resolution No. 5610 are hereby reaffirmed
Adopted by the City Council of the City of Orono, Minnesota at a regular
meeting held on the 23rd day of July, 2007.
