HomeMy WebLinkAboutResolution 5631i � \ A 1,4 CITY of ORONO RESOLUTION OF THE CITY COUNCIL A RESOLUTION GRANTING A SIX MONTH EXTENSION TO THE EFFECTIVE PERIOD OF PRELIMINARY PLAT APPROVAL ESTABLISHED PER RESOLUTION NO. 5489 - FILE NO. 06-3196 WHEREAS, on July 24, 2006, the City Council of the City of Orono (the "City") adopted Resolution No. 5489 granting preliminary plat approval for subdivision of a lot line rearrangement of property located at 1391 Fox Street and 1401 Shoreline Drive; and WHEREAS, City of Orono Municipal Code Section 82-117 establishes that preliminary plat approval is effective for one year from the date of such approval, and failure to file a complete final subdivision application within this time period shall be considered as formal withdrawal of the proposed subdivision; and WHEREAS, preliminary plat approval runs with the land, not the applicant; and WHEREAS, as a result of ongoing negotiations between the two applicants, Patrick McNaughton and Edward Hamm, and other factors, preparation of final plat submittals has been delayed. However, the applicants wish to continue the development process per the approvals granted in Resolution No. 5489; and WHEREAS, due to said delays the applicants have requested an extension of the effective period of preliminary plat approval, and City staff have recommended a six month extension to January 24, 2008. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono, Minnesota, as follows: 1. The effective period of preliminary plat approval is hereby extended to January 24, 2008; and 2. All other terms and conditions of Resolution No. 5489 are hereby reaffirmed.
