Sweet, a single person, (hereinafter "Owner") is the owner of the property located at 3405 Crystal Bay Road within the City of Orono (hereinafter "City") and legally described as: All of Lot 19 save and excepting West 20 feet of said Lot 19 and running from the North to South line of said Lot 19 heretofore taken for street purposes. Also a strip of land 20 feet wide formerly lying between Lots 18 and 19 and used for street purposes which said street has been vacated and said strip of land has by Decree of District Court, Hennepin County, declared to be part of said Lot 19. Also a part of Lot 18 beginning at the Northwest corner of said Lot 18, thence easterly 10 feet, thence South to rear line of said Lot 18, thence West 10 feet to Southwest corner of said Lot 18, thence North to point of beginning. All in Wallaces Addition to the Village of Minnetonka Beach, Hennepin County, Minnesota, according to the plat thereof on file and of record in the office of the Register of Deeds within and for said County(hereinafter "the Property"); and WHEREAS, the Owner has made application to the City for a variance to Municipal Zoning Code Section 78-1288 to allow 1.97 percent hardcover in the 0 to 75 foot zone when no hardcover is allowed and 32.7 percent hardcover in the 75 to 250 foot zone when the maximum is 25 percent; and WHEREAS, the Owner has made application to the City for a variance to Municipal Zoning Code Section 78-350 to allow a garage five feet from the westerly property line when a 15 foot setback is required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on March 19, 2007, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. This application was reviewed as Zoning File#07-3255. 2. The property is located in the LR-1C zoning district, where 0.5 acre is the minimum lot area and 100 feet is the minimum lot width. The property is approximately .39 acre in area and 80 feet in width. 3. The Planning Commission reviewed this application on March 19, 2007 and on a vote of 7 - 0 recommended approval of the variances, based on the following findings: a. The location of the house and the topography of the rear yard would make it very difficult to locate a garage at the required setback. - b. While the property to the west of this property is a street right of way it is very unlikely that it will ever be used for a road. It may be used for a trail. Impact of the garage on trail users would not be much different from a privacy fence the Owner could erect along the lot line in this area. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Owner but necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants variances to Orono Municipal Zoning Code Sections 78-1288 and 78-350 to allow consturction of a detached 20 foot by 24 foot garage, subject to the following conditions: 1. Council approval is based on the site and garage plans submitted by the Owner and annotated by City staff, attached to this Resolution as Exhibits A. and B. Any amendments to these plans may require further Planning Commission and City Council review. 2. This approval does not grant the Owner the right to maintain a driveway within the adjacent street right of way to the west of the property. That will be done by a separate Encroachment Agreement. 3. Hardcover in the 0-75' zone shall be limited to 92 s.f. or 1.97%. Hardcover in the 75-250' zone shall be limited to 4,075 s.f. or 32.70%. The Owner shall also be allowed 485 s.f. of driveway hardcover within the 0-75' zone of the adjacent street right of way and 480 square feet of driveway hardcover in the 75-250' zone of the adjacent street right of way. If the driveway is relocated to the Owner's property this amount of hardcover will be allowed on the Owner's property. The hardcover allowance summary is depicted on Exhibit C. The owner is advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 4. Owner shall not place any plastic or fabric liner material under any landscaping on the property to ensure their permeability as non-hardcover surfaces. 5. Authorities granted by this resolution run with the property not with the owner, but are permissive only and must be exercised by obtaining a building permit for the new construction before April 23, 2008 or the variances will expire on that date. 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically Page 3 of 5 (v. The undersigned Owner has read, understood and hereby agrees to the terms of this resolution and on behalf of her heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
