RIGHT-OF-WAY PERMIT. Subject to the terms and conditions established by city ordinances and as set forth herein, the CITY OF ORONO ("City") hereby grants a permit to Bollic and Sons, Inc ("Permittee") to allow the use of publicly owned or managed rights-of-way for the installation,repair, and maintenance of a sanitarv sewer service at 3165 Casco Circle . Permittee agrees to the terms of this Right-of-Way Permit Agreement. 2. PROPERTY. The right-of-way permit is for the right-of-way located in the City of Orono, County of Hennepin, State of Minnesota, described on the attached Exhibit"A". 3. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Permit Agreement, the Permittee shall deposit 5 thousand dollars and no/100ths �( 5,000.00) Dollaxs with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 4. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to repair any damage to public property, right-of-way, or infrastructure that is caused by the work (including planning, engineering, or legal consultant review) associated with the installation of a sanitary sewer service at 3165 Casco Circle . The City shall draw on the escrow to pay for all expenses associated with the work performed. 6. CLOSING ESCROW. The balance on deposit in the escrow, if any, shall be returned to the Permittee when the review has been completed and deemed acceptable by the City. 7. REVOCATION AND LAPSE. This permit will lapse if, within one (1) year of the issuance of this permit,the allowed construction has not been completed. C. The Permittee shall not open or disturb the paved surface of any public right-of-way for any purpose without first having obtained permission from the City, for which the City may impose reasonable conditions. D. After undertaking any work in the right-of-way, the Permittee shall restore the same, including paving and its foundation, to as good condition as formerly existed, and shall maintain the same in good condition for two (2) years thereafter.
