Sven Gustafson 1 Jesse Struve To: Christine Mattson Subject: 20120510 3165 Casco Circle Christine, I have reviewed the grading survey for 3165 Casco Circle and have the foliowing comments: � The survey needs to include a written legal description. � The survey has a note on it saying, "survey is subject to change per title or easement information". The survey should show all easements currently recorded against the property. /: The grading on the east side of the property needs to be adjusted to manage the storm water within the property limits. The proposed grading plan will direct additional storm water towards the neighboring property. � The drawing is tough to read and determine where the existing house is situated. It might be beneficial to remove the dimensions for the existing home. � Is there going to be a retaining wall on along the edge of the driveway ciose to the garage? The finished floor elevation is 960, but the proposed contours show a 1-2' height difference. If the homeowner is planning on grading this area, it should be reflective in the proposed contours. � The grading plan shows a tiered retaining wall south of the structure which will be 6.7' in height. The tiers need to be separated by more than 2x the greater height of the walls without engineering plans and specifications. It appears both walls will be 3.2' in height which means the walls will need to be separated by 3.2'*2 = 6.4'. When I scale it off it appears the walls are only separated by about 4'. This needs to be adjusted or engineering plans and specifications. • This project will require Minnehaha Creek Watershed District (MCWD) permit. The applicant needs to submit an approved permit from MCWD. �i The driveway should be shown all the way to the road, it currently stops at the property line. Y ;0 ►� � Ac�ct New D�elete TEMPORARY CERTIFICATE OF OCCUPANCY ESCROW AGREEMENT FOR Orono Building Permit#2012-00318 AGREEMENT made this�day of March, 2013, by and between the CITY OF ORONO, a Minnesota municipal corporation ("City") and Ward & Kathy Armstrong ("Owners"). Recitals 1. Construction of the new residence located at 3165 Casco Circle (the"Subject Property"), legally described as Lot 36 and 37 and adjacent vacated road, Sunset Park, Hennepin County Minnesota, which is the subject of building permit application number #2012- 00318 has been completed. 2. Winter conditions currently prohibit completion of exterior improvements, final grading, and vegetation establishment. An as-built survey cannot be accurately conducted at this time. 3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the Owners so that the Owners may occupy the new residence. 4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of exterior improvements, continuation of erosion control and submittal of an as-built survey to the City. NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for under a building permit application. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant review) associated with building permit #2012-00318 if compliance with the approved building permit is not accomplished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for eligible expenses the City has incurred. 5. CLOSING ESCROW. Bloomington, MN 55420 RE: Boulder Retaining Wall Evaluation 3165 Casco Circle Orono,Minnesota Project No. 13-0948 Dear Mr. Danforth: This letter is being sent per your request regarding the recently constructed boulder retaining walls at 3165 Casco Circle in Orono,Minnesota. This evaluation is based on observations I made during a site visit on June 26, 2013, and verbal statements made to me by you regarding construction means and methods. The construction of the retaining walls appear to be structurally stable and in general conformance with boulder retaining wall and construction industry standards. The walls were constructed with boulders of sufficient size and setback. Other typical construction details such as use of drainage elements and filter fabric also appeared to be followed correctly. As is normal for boulder retaining walls of this type, some wall movement and soil settlement should be expected. I recommend that gutters and downspouts be installed on the house in order to direct the roof runoff away from the retaining walls. Surface water should also be directed away from the walls. This evaluation was performed using the design guidelines presented in the third edition of the"Design Manual for Segmental Retaining Walls" (DMSRW)published by NCMA in 2009. If soil conditions, proposed layouts, or other design parameters vary from that assumed a revised analysis might be needed. Please call me if you have any questions or need more information.
