Recitals
1. Owners have filed Building Permit Application #2012-00066 and Zoning Application #11-3521
formally requesting the City to review plans for a screen porch and garage additions located at 3131 Casco Circle
the "Subject Property") legally described as Lot 44 and that part of Lots 43 and 64 lying West of line and its ext.
100 ft West of and parallel with East line Lot 42 and that part of Lot 45 lying East of a line 75 feet West of and
parallel with the East line of Lot 44, and that part of adjacent vacated Lakeshore Ave and tract of land between
said Avenue and Lake Minnetonka lying between extensions of East and West lines of above, Spring Park,
Hennepin County, Minnesota..
2. Owners request the City to review said plans which requires City approvai including a variance
and building permit. �
3. The City is willing to commence its review of the appiication and incur costs associated with said
review only if the Owners establish an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consultant review) or will
incur in meeting with the Owners, reviewing the plans, and preparing agenda packet material for City Council
review of building permit application #2012-00066 and variance application 11-3521. Eligible expenses shall be
consistent with expenses the Owners would be responsible for under a zoning and subdivision application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shali be responsible for payment to the City within 30 days of the Owners'
receipt of bilL
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall cease all reviews until the Owners pay all
expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

Land Use Application#11-3521 pertaining to 3131 Casco Circle is complete. The Applicant,
Tami Helmer, has requested a refund of her$700 escrow.
As-built survey reviewed in house.
Despite having a signed escrow agreement for$2,500, per my conversation with Ms. Helmer
she issued four checks to the City. They are as follows:
July 2011 11-3521 $700 (application fee)
July 2011 11-3521 $700 (escrow)
February 2012 2012-00666 $1,348.89 (advanced plan review fee)
March 2012 2012-00666 $2,211.75 (balance of permit fee)
I also reviewed the Receipt Register for 2012 for Escrow Deposits and found no other funds
deposited for this address.

We have reviewed the plans for a proposed addition and grading for the existing home at 3131 Casco Circle.
The plans are dated 10-5-11. We have the following comments with regards to engineering matters:
• The plan is acceptable from an engineering standpoint.
• This project will disturb more than 100 CY of material. Sediment and erosion control information
meeting the requirements of Orono's City Code 79-7(c)(2) must be submitted. The minimum $2000
sediment and erosion control financial security should be required of the owner for this permit.

I'm in the process of reviewing the building plans for your addition/remodel. See attached... I came across the west side
window shed roof and realized that it encroaches about 2.25' further into the average lakeshore setback than the
approved plan. This shed roof should be revised to reflect no greater encroachment than shown on the approved plans.
The width of the window is not a concern to me but the projection of the roof in this area is... I can redline this area or
you can provide a revised page. Please advise.
