I have completed the Checklisf for Refunding Bui/ding Permit Escrows and find Building
Permit application 2009-00132/2009-00168 pertaining to 3127 Casco Circle is complete. The
Applicant, Stonewood, LLC on behaif of the owner, Frederick Peters, has requested a refund
of the$2,500 application escrow.

In response to the voicemail you left Melanie Curtis:
3127 Casco Circle — Peters: The final certificate of occupancy was issued on December 13,
2010 (copy attached). This property currently has a balance due of $618.23. This is the final
bill including December charges. Once payment is received we will process the escrow
refund, which involves City Council approval (expenditure approval is standard procedure at
each Council Meeting). Payment would need to be received by Noon on Thursday, January
20t" in order to make the deadline of the next Council meeting on Monday, January 24tn
1785 Concordia — Dulin: In February 2010, we refunded the zoning application escrow
($2,500), we still hold the building permit escrow of $2,500. As you know, we cannot issue a
certificate of occupancy or refund the building permit escrow until Spring.

Our policy is not to deduct from the escrow until the point of certification of outstanding bills. I.e. we wouldn't certify a
bill if the escrow will cover the balance. However, on a regular basis is not something our accounting department is
equipped to do at this time. The bill must be paid in full and then the escrow refund will be processed. Sorry for the
inconvenience.

1785 Concordia — Dulin: In February 2010, we refunded the zoning application escrow ($2,500), we still hold the
building permit escrow of$2,500. We cannot issue a certificate of occupancy or refund the building permit escrow
without verification of the site conditions on the as-built (see attached). According to our engineer this will now have to
take place in the spring due to the snow.

BUILDING PERMIT ESCROW AGREEMENT

Recitals
1. Appli tG�L�__has fte_d_�n-6�p{�1Lcation for a building permit formally requesting the City to review plans

the"Subject Property"), as more fully shown and described on Exhibit"A" attached hereto.
2. Applicant requests the City to review said plans which requires City approval including
3. The City will commence its review of the application and incur costs associated with said review
only if the Applicant establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Applicant sha►I deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City
to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Applicant would be responsible for under a zoning and subdivision application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Applicant. Applicant shall be responsible for payment to the City within 30 days of the
Applicant's receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Applicant does not make
payment to the City within the timeframe outlined in #3 above, the City may draw from the escrow account without
further approval of the Applicant to reimburse the City for Eligible expenses the City has incurred. The City shall
notify the Applicant the Applicant of such draw and the nature of the expense for which the reimbursement is
being made. If the Escrow amount falls below 75% of the original escrow amount the Applicant shalf deposit
additional sums as directed by the City, or the City shall discontinue review and post a Stop Work Order.
4. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Applicant when the review has been completed and written notification is received from the Applicant requesting
the funds.
5. CERTIFY UNPAID CHARGES. ff the project is abandoned by Applicant, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the,,right to certify the unpaid
balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.01 Z. �"�

We have reviewed the grading plan dated 5-19-10 for 3127 Casco Avenue for compliance with
Chapter 79 of Orono's Land Use Code. We have the following comments:
• Proposed slopes exceed the maximum allowable slopes of 3:1 in many areas. This
must be revised.
• This project will disturb more than 100 CY of material. Sediment and erosion control
information meeting the requirements of Orono's City Code 79-7(c)(2) must be
submitted. The minimum $2000 sediment and erosion control financial security
should be required of the owner for this permit.

I would like to clarify. The revised grading plan for the lake side of the property(which was submitted) does not appear
to have changed and is acceptable. The street side grading has slopes that exceed 3 to 1 and must be revised. However,
the photographs submitted by the neighbor after the rain last week show grading that it is completely inconsistent with
the approved plan on the lake side of the house on the Dudley's side.
You are hereby notified that by 5 PM on Friday(July 9`h)the lake yard should be graded according to the approved plan.
Please assure that the site is in compliance with your erosion control plan. Also, please reinforce your silt fence with
steel t-posts.
We will be out to inspect the site Monday morning before topsoil and sod are put down. If you do not have the lake
yard properly graded at that time, the City will immediately use the $2000.00 cash escrow submitted by the homeowner
to correct the grading and secure the site.
