I don't know if you saw this email or not. I think we should start watching Sven more closely on this project. It took a
long time to finally get an acceptable grading plan and it appears he may not be following it. It also looks like the erosion
control on this project is failing or not installed properly.

Eric.....I am the owner of the property (3125 Casco Circle) next door to Fred Peters on the North. You left a
card in my door indicating you are the construction project manager and to contact you if I have any questions
or concerns.
As you are likely aware from Sven, my only reservation about the project was the subject of run-off water onto
my property and the part of my patio covered by an easement. I was assured by Sven that the proposed plan and
grading would prevent a water run of£ The prevention was to include a graded "swale" to direct water away
from the adjacent patio and end capping to prevent errosion of the easement.
The back-fill and grading that was done did not appear to be in conformance with the plan. It rained last night
and I awoke this morning with about 1/2 inch to 1 inch of mud on the patio and covering one of my patio drains
completely. The "swale" was mostly washed out onto the patio. I am attaching a number of pictures showing the
situation. I am certain the swale was not properly done as dirt was at an elevation above the patio floor. I had
put some rocks and a piece of railroad tie I had cut to help prevent dirt from running onto the patio but it just
flowed underneath these make-shift devices.
Further, no effort has been made to "end cap" the excavation to prevent the exposed dirt holding the patio
easement from washing away. I am fearful that this could lead to a collapse of the lattice or even the stone
barbecue if left exposed and if we have some heavy rains this fall. I have enclosed pictures of that situation also
in which you can see that some of the dirt is washing away from the easement toward Fred's.

One of your sub-contractors, Concrete Science, did replace a section of the lattice they damage with their
digging equipment but the supporting post was also loosened by the encounter with the equipment but cannot be
fixed until the "end capping" is complete. Can you tell me when the "end capping" will occur so the support
post can be secured?
I would asked: "what is the plan to correct the situation so that I am not having to deal with mud flowing onto
the patio and into my drain and how soon wii that plan be effected?"

Eric.....We appreciate that you called on Monday August l Oth to indicate that you would send someone out to
clean up the mess. Of course we had to clean it up ourselves Sunday August 9th since we were not aware of
when the issue would be addressed and we were afraid that more rain might be on the way. In any event we
personally did the work and as you can see by the first few attached pictures plus e-mail #2 that not only was it
an issue of mud on the patio but mud stopping up our patio drains.
You did send a young man out to sweep what little was left and did lay down a few more "silt" bags. We
indicated to the young man that we didn't think that would resolve the problem and also expressed our concern
about not having the area "Capped" as the banks of dirt might collapse. He said he would relay our concerns.
We hate to say our concerns proved valid. With the rains we just had, an even greater amount of mud poured
onto our patio and the amount of mud stopping up our drains was enormous. We are fairly certain we now will
need to have a sewer service firm come out to flush and remove all the dirt that tried to wash down the
drain. The second set of pictures indicates how bad it was with over 7 inches of dirt being piled up. These
pictures will be attached to a 3rd and 4th e-mail as we are restricted to the total attachment size per e-mail your
system will accept.

. This time we are not cleaning it up ourselves and if it is not cleaned up (or we do not hear from you) by Monday
noon (August 23rd) we intend to employ a firm to do so along with the sewer service firm. We would expect
you to pay for the cost of the cleanup.
More importantly, we feel it is essential to "cap" the raw excavation and finish the appropriate grading NOW to
prevent this from being a reoccurring issue. In the alternative, another solution might be to remove back-fill
from the garage foundation sufficient to make the dirt be lower than the patio by at least a foot and to keep it
that way after every rain.
We are asking that the City of Orono inspect the property now and review with you what plan you will
implement to ensure that there will be no further runoff of mud from the project onto our patio and into our
drains during the remainder of the construction.
After seeing the roof lines and the amount of water that will come off of the structure (especially with the
garage roof sloping toward the patio) we are growing skeptical that the final grading and existing plan will
prevent water from flowing on-to our patio unless the end-cap is actually a concrete wall. It appears you
intended to use the salvaged timbers as end cap material and that definately would not prevent the water
from flowing on-to our patio.

Eric.....I am the owner of the property (3125 Casco Circle) next door to Fred Peters on the North. You left a
card in my door indicating you are the construction project manager and to contact you if I have any questions
or concerns.
As you are likely aware from Sven, my only reservation about the project was the subject of run-offwater onto
my property and the part of my patio covered by an easement. I was assured by Sven that the proposed plan and
grading would prevent a water run off. The prevention was to include a graded "swale" to direct water away
from the adjacent patio and end capping to prevent errosion of the easement.
The back-fill and grading that was done did not appear to be in conformance with the plan. It rained last night
and I awoke this morning with about 1/2 inch to 1 inch of mud on the patio and covering one of my patio drains
completely. The "swale" was mostly washed out onto the patio. I am attaching a number of pictures showing thf
situation. I am certain the swale was not properly done as dirt was at an elevation above the patio floor. I had
put some rocks and a piece of railroad tie I had cut to help prevent dirt from running onto the patio but it just

. flowed underneath these make-shift devices.
Further, no effort has been made to "end cap" the excavation to prevent the exposed dirt holding the patio
easement from washing away. I am fearful that this could lead to a collapse of the lattice or even the stone
barbecue if left exposed and if we have some heavy rains this fa1L I have enclosed pictures of that situation also
in which you can see that some of the dirt is washing away from the easement toward Fred's.
One of your sub-contractors, Concrete Science, did replace a section of the lattice they damage with their
digging equipment but the supporting post was also loosened by the encounter with the equipment but cannot be
fixed until the "end capping" is complete. Can you tell me when the "end capping" will occur so the support
post can be secured?
I would asked: "what is the plan to correct the situation so that I am not having to deal with mud flowing onto
the patio and into my drain and how soon wii that plan be effected?"

clean up the mess. Of course we had to clean it up ourselves Sunday August 9th since we were not aware of
when the issue would be addressed and we were afraid that more rain might be on the way. In any event we
personally did the work and as you can see by the first few attached pictures that not only was it an issue of
mud on the patio but mud stopping up our patio drains.
You did send a young man out to sweep what little was left and did lay down a few more "silt" bags. We
indicated to the young man that we didn't think that would resolve the problem and also expressed our concern
about not having the area "Capped" as the banks of dirt might collapse. He said he would relay our concerns.
We hate to say our concerns proved valid. With the rains we just had, an even greater amount of mud poured
onto our patio and the amount of mud stopping up our drains was enormous. We are fairly certain we now will
need to have a sewer service firm come out to flush and remove all the dirt that tried to wash down the
drain. The second set of pictures indicates how bad it was with over 7 inches of dirt being piled up. These
pictures will be attached to a second e-mail as we are restricted to the total attachment size per e-mail.
This time we are not cleaning it up ourselves and if it is not cleaned up (or we do not hear from you) by Monday
noon (August 23rd) we intend to employ a firm to do so along with the sewer service firm. We would expect
you to pay for the cost of the cleanup.
More importantly, we feel it is essential to "cap" the raw excavation and finish the appropriate grading NOW to
prevent this from being a reoccurring issue. In the alternative, another solution might be to remove back-fill
from the garage foundation sufficient to make the dirt be lower than the patio by at least a foot and to keep it
that way after every rain.
We are asking that the City of Orono inspect the property now and review with you what plan you will
implement to ensure that there will be no further runoff of mud from the project onto our patio and into our
drains during the remainder of the construction.
After seeing the roof lines and the amount of water that will come off of the structure (especially with the
garage roof sloping toward the patio) we are growing skeptical that the final grading and existing plan will
prevent water from flowing on-to our patio unless the end-cap is actually a concrete wall. It appears you
intended to use the salvaged timbers as end cap material and that definately would not prevent the water
from flowing on-to our patio.

Eric.....I am the owner of the property (3125 Casco Circle) next door to Fred Peters on the North. You left a
card in my door indicating you are the construction project manager and to contact you if I have any questions
or concerns.
As you are likely aware from Sven, my only reservation about the project was the subject of run-off water onto
my property and the part of my patio covered by an easement. I was assured by Sven that the proposed plan and
grading would prevent a water run off. The prevention was to include a graded "swale" to direct water away
from the adjacent patio and end capping to prevent errosion of the easement.
The back-fill and grading that was done did not appear to be in conformance with the plan. It rained last night
and I awoke this morning with about 1/2 inch to 1 inch of mud on the patio and covering one of my patio drains
completely. The "swale" was mostly washed out onto the patio. I am attaching a number of pictures showing the
situation. I am certain the swale was not properly done as dirt was at an elevation above the patio floor. I had
put some rocks and a piece of railroad tie I had cut to help prevent dirt from running onto the patio but it just
flowed underneath these make-shift devices.
Further, no effort has been made to "end cap" the excavation to prevent the exposed dirt holding the patio
easement from washing away. I am fearful that this could lead to a collapse of the lattice or even the stone
barbecue if left exposed and if we have some heavy rains this falL I have enclosed pictures of that situation also
in which you can see that some of the dirt is washing away from the easement toward Fred's.
One of your sub-contractors, Concrete Science, did replace a section of the lattice they damage with their
digging equipment but the supporting post was also loosened by the encounter with the equipment but cannot be
fixed until the "end capping" is complete. Can you tell me when the "end capping" will occur so the support
post can be secured?
I would asked: "what is the plan to correct the situation so that I am not having to deal with mud flowing onto
the patio and into my drain and how soon wii that plan be effected?"

Sven......Thank you for having the mud shoveled away. I am guessing they needed to let the flagstone dry
before they can sweep up the surface dirt that was left from the shoveling.
What time tomorrow will the sweeping be done?
I am still puzzled as to why so much dirt has been piled between the patio and the garage being constructed.
Your plan calls for the elevation of the swale to at the same elevation as the patio/flower bed components. There
is considerably more dirt so that the dirt is elevated to a level above the patio and has no where to go in a rain
except in the direction of the patio. Also the plan says the swale area was to be graded away from the patio so
that water drains away and not toward the patio as is now the case. If eventually the plan is followed, why all
the extra dirt piled up now?
The temporary "fix" that was done today was to place some 4x8 plywood in an attempt to catch the dirt as it
runs toward the patio. I am skeptical that this will work and am scratching my head as to why leave all the extra
dirt in a position that it has to be "caught"? Why can't the dirt just be removed now if it has to be graded to the
patio/flowerbed elevations when the construction is finished.

equipment to measure elevations I cannot say for certain that the grading on Fred Peters property doesn't
conform to the plan, but my eyeball sure seems to believe it is about 2-3 feet above my property at critical water
run off points.
Who does the check to be sure the work is according to plan and when is the check made so that corrections are
still possible if necessary?
Am I reading the plan correctly that elevations would be matched across Fred's property so at the property
line the flows would not come my direction (especially at the swale area and where the tennis court use to be)?

the Orono Council Meeting). After seeing the pictures I've sent recently, do you think they will be able to
correctly divert water away from the patio and make the swale work?

side of that wall? It would seem that this would make a barrier to stop water from running onto the patio.
At the moment, we are really concerned that the water/drainage issue is not under control and perhaps the plan
will not work or is not being followed. What is your view of this?

EXTRACT FROM THE MINUTES OF THE ORONO CITY COUNCIL MEETING
Monday,April 14,2008 7:00 o'clock p.m.
Gustafson stated basically the street side of the property drains to the area that is delineated in red
on the overhead and that they would like to pitch the driveway to the south more to help drain the
water away from the neighbor's easement and help direct the runoff across the property.
Kellogg pointed out the arientation of the garage also restricts the abiliTy to construct a swale in
that area. Kellogg noted they would be visiting the property tomorrow to review the drainage
situation and that it is likely the applicant would need to submit some drainage calculations and a
revised drainage plan showing how they would handle the runoff.
Kellogg stated if the application is approved with a number of conditions, someone would need to
monitor the application to ensure that all the conditions were completed.
Turner noted Staff has not prepared a resolution for this application and that the City Council
could direct Staff to draft a resolution at this time but not to bring it forward to the City Council
until the issues relating to drainage are resolved to the satisfaction of the City Engineer.
Murphy moved,Rahn seconded,to direct Staff to draft a resolution for Application#08-

I have been staying tuned to your emails over the past few weeks and have been ith the
city are copied on them, You may or may not know that Evelyn has been out of tf,.. ,,...__ _ , is not
expected back for another three weeks. In the interim please forward your emails to Melanie and Lyle (copied on this
email) and feel free to copy me on any and all emails.
I discussed your concerns with Lyle earlier today and he indicated he had been out to the site today and met with the
contractor. Lyle believes the temporary erosion control measures in place now will prevent further impacts to your
property. Lyle is confident that the approved grading plan can be implemented once construction on the house gets a
little further along. He has also indicated he will try to get the home builder to pay attention to the grading on your side
of the lot as soon as things dry out.
Based on the photos you submitted I agree that the excess dirt between the new home and yours should and could be
removed now. I discussed this with Lyle and he will get the contractor to get this done as soon as conditions permit.
I hope this is the last of the encroachments onto your property as a result of this project. Please keep me in the loop and
I will do what I can to help under the direction of Melanie.
