I relayed to you the information that our engineer needed to see on the plans— the storm sewer location. Tom Kellogg, our engineer, and I reviewed your updated sketch today and it is unclear what the grades are in the location of the storm sewer locations. It is also unclear based on your sketch what is existing and what is proposed, or what exactly is going to be done other than construct a new deck and fireplace. I spoke with Mr. Davies this afternoon and got the impression he wanted to expedite the issuance of the building permits. The fastest way to do so is to provide the City with a certificate of survey—which meets our requirements (attached) specifically(2)the existing and proposed grades, (3&4) any new structures or changes to existing structures. The (1) elevations of the storm sewers are also required. Any areas proposed to be graded or changed on the property must be identified. While we feel it would be good book keeping for the City to have an easement over the existing pipe through Mr. Davies back yard we do not want to tie the easement request to the permit for the work Mr. Davies would like to complete. The easement and the landscaping work that they are requesting a permit for are two completely different matters that seemed to dovetail with each other. It appears Mr. Davies thinks we are trying to leverage the City request for a drainage and utility easement in exchange for the permit to do the landscaping work. We are not and to make that clear and hopefully expedite the issuance of the permit to Mr. Davies I would recommend that we withdraw our request for the drainage and utility easement and permission to grade on Mr. Davies property until some later date. i , I know you have previously requested a survey showing existing and proposed contours on the property. In the event the survey has not been prepared, as a compromise, I would be willing to sign off from an engineering perspective if the work proposed does not go beyond the limits of the proposed patio and fireplace. In other words if the contractor can certify or guarantee that no grading or grade changes would occur south and west of the proposed patio and fireplace we could support not requiring the previously requested survey. As I review the plan on my desk prepared by Outdoor Escapes dated 4-17-10 it appears there is work planned in the SW corner of the property. It appears the work planned includes the installation of plantings, flagstone and some type of a water feature. It was my understanding that the only work proposed at this time was the patio and fireplace immediately adjacent to the SW corner of the house. If the work includes the area in the SW corner of the property I recommend that you verify that with the applicant and request any further information you may need to permit this work. If the work in the SW corner of the property is included we will need additional information to understand what grading, if any, is planned and how this may affect the existing storm sewer catch basin and drainage way from north to south through the rear yard. In closing I want to be clear, we are not requesting a drainage and utility easement or permission to grade on Mr. Davies property at this time. We want to do what we can to help expedite the permitting process while ensuring the City has the necessary documentation to issue the permit. Please let me know if you need anything else. We will not sign off on this work until a conceptual drawing has been completed showing elevation changes through the proposed re-graded area. In exchange for the city's acceptance of the above, we are willing to allow Orono to have a maintenance and utility easement for the purpose of maintaining and fixing problems with the pipe that runs through the yard and agree to sign paperwork that will be needed for such as well as what would be needed for the City and Bonestroo to enter the property and begin work. As mentioned below, much - if not all -of the work proposed above is in a different part of the yard than the proposed new deck and fireplace, therefore I would appreciate the work permits being accelerated and given to Outdoor Excapes. If there is additional data or information needed for the permits, please explain what is missing as soon as possible. In the event we cannot agree on the above compromise in the next day or so and/or no explanation is given for missing data in the permit requests, the next step would be for me to hire a lawyer to determine why the City of Orono is delaying a valid permit request, which would be regrettable.
