I appreciate the email. I have a few concerns.
1. The erosion at the top of the hill is not really improved, but is about the same as the "before" photo you
attached. The grass mat added by the contractar has not really stabilized. It has been washed away and all that
is left in the plastic mesh.
2. The swale washout/erosion is worse than ever and my concern is that it does not appear able to withstand
even a 1 year rain event. (see attached photo) I realize this has been a wet summer,but just look at that photo!
There is standing water from the drain to the lake. There is crap washing into my yard and into the lake. The
water in front of my house currently has a sludgy film covering the water at the area the drainage enters the
lake. As I mentioned when we met, this swale area has never been completely dry since you installed it.
This really is unacceptable and my concern is that by directing all of the neighborhood's rain runoff into my
yard, you have created a situation where I will be dealing with this wet, soggy eyesore from now on, not to
mention the damage to the water quality in front of my house. As I reported when we met, I really wasn't given
any good choices in this scenario - either add the drain/swale or don't - either way, all the drainage from the
neighborhood was still going to come through my yard. As it is, my yard and the lake have never been worse in
the 33 years Ibe been at 2691 Carloine Ave.
I look forward to hearing your schedule for making these adjustments to the swale and I hope they address the
problems. Right now, I am concerned about the success of your plan.

To follow up on our June 24th site meeting, here is a summary of what was discussed:
• One concern is the wet condition of the swale and the lack of grass in spot locations in the swale. Given the wet
conditions last fall and this spring, the street drain tile has been running constantly, keeping the swale wet, even
after a week without rain. The lake level has also backed up into the swale, but the main concern is the water
standing in the swale on the upstream half.
• The ponding in the swale is due to a lack of grass growing in a few locations. These areas were reseeded a
couple times in 2010 when the swale was actually dry, but the seed most likely washed away with a rain. If
these bare areas had grass growing in them, the water would not pond in the swale, but would slowly flow to the
lake. If these wet conditions continue, the swale can be expected to have water feeding it from the drain tile in
the street and from the back yards south of your property. Under typical conditions, the swale will be dry within
a few days.
• There was also a question of whether or not the swale even drained from the pipe to the lake. Don and I
surveyed the swale and it has 1.2' of elevation difference from the pipe to the lake, which was anticipated with
the design. This equates to about 1.5% grade.
• Another question was can the swale will withstand a larger than normal rain event. The answer is yes, it was
designed based on a 10 year rain event, which statistically should only occur once every 10 years, and is larger
than average.
• There was a concern about erosion at the top of the hill due to construction work on site. I believe it has
significantly improved from the existing conditions prior to construction (See Photo). I am hesitant to disturb it
again given that it was restored a couple times by the contractor in order to get it stabilized.
• In order to reduce the likely hood of water ponding in the swale, the City will have the Contractor raise the end of
the pipe 4 to 6 inches in order to improve the slope of the swale from the end of the pipe, to a point half the
distance to the lake. The contractor will add topsoil, use the reinforced turf mat and sod to complete the
restoration. We all agreed that the portion of the swale from the lake, half way to the pipe appeared to be fine
as is.
• The City is waiting for the easement documents to be signed by you so that the easement can be filed with
Hennepin County. It is preferred that the easement documents be signed and delivered to the City prior to the
remaining restoration work taking place. We understand that you are using the easement as leverage to get the
restoration complete, but given that the City has been cooperative throughout this entire situation, we are not
sure that leverage is necessary.
• Given the wet conditions, it may still be a month, or even two, before the work can be completed. I will be in
contact with you regarding the timeline.

1. The erosion at the top of the hill is not really improved, but is about the same as the "before" photo you
attached. The grass mat added by the contractor has not really stabilized. It has been washed away and all that
is left in the plastic mesh.
2. The swale washout/ erosion is worse than ever and my concern is that it does not appear able to withstand
even a 1 year rain event. (see attached photo) I realize this has been a wet summer, but just look at that photo!
There is standing water from the drain to the lake. There is crap washing into my yard and into the lake. The
water in front of my house currently has a sludgy film covering the water at the area the drainage enters the
lake. As I mentioned when we met, this swale area has never been completely dry since you installed it.
This really is unacceptable and my concern is that by directing all of the neighborhood's rain runoff into my
yard, you have created a situation where I will be dealing with this wet, soggy eyesore from now on, not to
mention the damage to the water quality in front of my house. As I reported when we met, I really wasn't given
any good choices in this scenario - either add the drain/swale or don't - either way, all the drainage from the
neighborhood was still going to come through my yard. As it is, my yard and the lake have never been worse in
the 33 years I've been at 2691 Carloine Ave.
I look forward to hearing your schedule for making these adjustments to the swale and I hope they address the
problems. Right now, I am concerned about the success of your plan.

To follow up on our June 24th site meeting, here is a summary of what was discussed:
• One concern is the wet condition of the swale and the lack of grass in spot locations in the swale. Given the wet
conditions last fall and this spring, the street drain tile has been running constantly, keeping the swale wet, even
after a week without rain. The lake level has also backed up into the swale, but the main concern is the water
standing in the swale on the upstream half.
• The ponding in the swale is due to a lack of grass growing in a few locations. These areas were reseeded a
couple times in 2010 when the swale was actually dry, but the seed most likely washed away with a rain. If
these bare areas had grass growing in them, the water would not pond in the swale, but would slowly flow to the
lake. If these wet conditions continue, the swale can be expected to have water feeding it from the drain tile in
the street and from the back yards south of your property. Under typical conditions, the swale will be dry within
a few days.
• There was also a question of whether or not the swale even drained from the pipe to the lake. Don and I
surveyed the swale and it has 1.2' of elevation difference from the pipe to the lake, which was anticipated with
the design. This equates to about 1.5% grade.
• Another question was can the swale will withstand a larger than normal rain event. The answer is yes, it was
designed based on a 10 year rain event, which statistically should only occur once every 10 years, and is larger
than average.
• There was a concern about erosion at the top of the hill due to construction work on site. I believe it has
significantly improved from the existing conditions prior to construction (See Photo). I am hesitant to disturb it
again given that it was restored a couple times by the contractor in order to get it stabilized.
• In order to reduce the likely hood of water ponding in the swale, the City will have the Contractor raise the end of
the pipe 4 to 6 inches in order to improve the slope of the swale from the end of the pipe, to a point half the
distance to the lake. The contractor will add topsoil, use the reinforced turf mat and sod to complete the
restoration. We all agreed that the portion of the swale from the lake, half way to the pipe appeared to be fine
as is.
• The Ciry is waiting for the easement documents to be signed by you so that the easement can be filed with
Hennepin County. It is preferred that the easement documents be signed and delivered to the City prior to the
remaining restoration work taking place. We understand that you are using the easement as leverage to get the
restoration complete, but given that the City has been cooperative throughout this entire situation, we are not
sure that leverage is necessary.
• Given the wet conditions, it may still be a month, or even two, before the work can be completed. I will be in
contact with you regarding the timeline.

To follow up on our phone conversation, I am concerned about the next steps with Harry Pulver at 2691 Caroline Ave.
After our site meeting is seemed that him and his wife were happy with the solution of raising the outlet 6 inches and
grading the upstream half of the swale to have better grade. But his email below gives the impression that he will not be
satisfied.
From his email response, the impression is that he may not be satisfied with that option, and the City may have a difficult
time getting the easement documents, even after completing grading improvements.
Here are a few options for moving forward with the situation that may be worth discussing with staff and Tom:
1. Wait to do any improvements to see if the swale dries up, and the lake levels go down. This could be into next
spring. The unexpected issue is the constant water running from the drain tile that was stubbed to the south of Pulver's
driveway. If everything does dry up, under "normal conditions" then the City delivered on the agreement I made with
Harry before starting the project, and no further work would be needed.
2. Discuss the options of rain garden plantings in the swale with Mr. Pulver, and see if this is an option he and his wife
would prefer. This way the swale being wet would not be an issue for them. I am working with John Smyth to get an
estimated cost to install plantings, and any other necessary mulch or preventative materials.
3. Raise the outlet, as discussed with the homeowner, with the understanding water may run through it a majority of the
summer.
Does it make sense, given all of the options, that the City should not proceed without the easement document in hand?
