I understand there is a drainage prablem on the area between Mr. Pulver' s property and yours. Mr. Pulver is very upset at the fact that you allegedly entered his property and moved some hay bales that he had arranged on his property and that later that same evening, you came to his front door and intimidated him to the point where Mrs. Pulver was crying. Mr. Pulver states that he has a heart condition and does not wish to have contact with you on this drainage matter. This matter should be handled through the City of Orono and yourself. Further, l�sr. Pulver requests that an�� contact with Mr. Pulver be through his attorney, Mr. John James at 332-8211. I would caution you that entering on anothers property in this fashion might conceivably amount to trespassing or consti- tute harrassment. Residential dwelling means any single building consisting of one through three dwelling units with individual kitchen facilities for each. (Code 1984, §9.01(1)) Cross referenc�Definitions generally, § 1-2. Sec. 54-32. Storage. (a) It is unlawful for any person to store refuse on residential dwelling premises for more than one week. All such storage shall be in five-to 50-gallon metal or plastic containers with tightfitting covers, which shall be maintained in a clean and sanitary condition. Tree leaves, weeds and grass clippings may be stored in plastic bags and tree limbs must be stored in bundles weighing no more than 75 pounds and no longer than four feet. �b) It is unlawful for any person to store refuse on multiple dwelling premises for more than one week. Such storage shall be in containers as for residential dwelling premises; except that containers, sometimes referred to as dumpsters, with closefitting covers may be substituted. ��) It is unlawful for any person to store refuse on commercial establishment premises for more than 48 hours. Refuse must be deposited at one place, at ground level, on each property. Refuse containers must be returned and placed behind the yard setback line by the owner or tenant on the same day that the garbage or refuse is collected. The intent of this subsection is to allow only on the prior evening and the day of collection the garbage or refuse container to be in front of the yard setback line. (Code 1984, §9.01(2)) Sec. 54-33. Deposit. It is unlawful for any person to deposit in the city any refuse from any source, rubbish, offal or the body of a dead animal in any place other than a licensed sanitary landfill. (Code 1984, §9.01(3)) Sec. 54-34. Fire danger. It is unlawful for any person to store, deposit or dispose of any refuse which is in flames or heated to the point where it could cause danger of fire in other refuse. Reserved. https://library.municode.com/print.aspx?h=&clientID=13094&HTMRequest=https%3a%2f... 6/2/2014 December 2, 1987 I, Harry Emil Pulver, DOB/5-12-20 , of 2691 Caroline Avenue, on Casco Point, in the City of Orono, wish to relate the following facts: I repaired the slope going down to the lake and I am in the process of protecting it from heavy water flow until the sod takes hold, I sodded it. In order to do this I put a few bales of hay (pictures available to show this) across the property with a 2 inch space between them so the water can get between them - I want to spread the water out, is what I want to do. In order to make sure that I wasn' t breaking any rules, regulations or ordinances , I went to the City of Orono and had Mike Gaffron, the asst. zoning administrator and Glenn R. Cook, the City Engineer for Orono, come down and see what I was doing and they said they see absolutely no �roblem with what I was doing, therefore I went ahead with it. The man next door, Joe Clemens, started out verbally abusing me and telling me that he didn' t want it there and then a couple days later he stopped me by my mailbox, and I wasn' t feeling well at all, and started in again telling me to move the bales. So I did move two and I am not -supposed to do strenuous exercise, but I moved two. I called up the City and they said go ahead and put them back , its okay. On MOnday night he took the bales of hay and threw them further up on my property, just threw them up there. I then put the bales back and a contractor suggested that I spike them to the ground with some spikes or wooden sticks or pipes or whatever I had, and I have to admit that I watered the bales down so they'd be good and heavy so he couldn' t move them. Then later that evening around 9 oclock, he came to my front door and immediately started out with a tirade that he was going to sue me that he was going to take me to court, that he was qoing to take my land away, he went on and on and on. Those bales had to go accordina to him and he was very abusive to me and my wife and my wife was crying and he just kept on and on and on. I told him we had lived there for 10 years and we never had any trouble with anybody on any side, even that hill, the neighbor and I would fix it up.
