A RESOLUTION
GRANTING A VARIANCE TO
MUNICIPAL ZONING CODE
SECTION 7�-78-'{279(6)
FILE NO. 'E 3-3642
WHERERS, Ziv Liberman and Tal Liberman, a married couple (hereinafter "the
Appficants") are the owners of the property located at 2f90 Caroline Avenue within the City of
Orono (hereinafter the "City"} and legally described as follows:
Attached as Exhibit A(hereinafter the "Property"); and
WHERE�RS, the Applicants have made appfication to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1279(6) to alfow construction of a new
above grade patio ahead of the average fakeshore setback in conjunction with the construcfion
of a new single family residence on the Property; and
WHEREAS, after due pubfished notice and maifed notice in accordance with
Ninnesota Statutes and the Orono, Niinnesota, City Code, the Orono Planning Commission held
a pubfic hearing on November 18, 2013 at which times all persons desiring to be heard
concerning this appfication were given the opportunity to speak thereon.
N�VI�, �H�R��ORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDIN�S
1. This application was reviewed as Zoning File number 13-3642.
2. The Property is iocated in the LR-1 C One Famify Lakeshore Resident�al Zoning
District whicn requires a minimum fot area of �.5 acre and a minimum lot width of
100'.
3. The Pfanning Commission reviewed this appfication at a public hearing hefd on
November 18, 2013 and voted 5 for and 0 against on a motion to approve the
ave�age iakeshore setback variance base� on the foliowing finaings:
a. The Property contains 28,994 square feet in area and has a defined width of
225-feet at the iake and 122-feet at the 75-foot setback.

b. The Planning Commission finds a new home can be constructed to meet the
required average {akeshore setback.
c. The Property has a unique shape and a large 0-75' area which partialiy
functions as though it is a peninsula.
d. Both adjacent neighbors (at 2691 Carofine Avenue and 2696 Caroline
Avenue) have submitted letters of support for the appfication including the
average fakeshore setback variance as requested.
e. The proposed efevated patio and associated grading will meet the 75-foot
lake setback.
f. The Property will conform ta the hardcover limitations of Tier 1.
g. The Appficants' proposed efevated patio wil� not alter the essential character
of the neighborhood and will result in minimal or no negative impact on
adjacent properties.
h. The Appiicants' proposal to remove the existing above grade deck and move
the outdoor fiving space to the southeast side of the Property wili improve the
potential lake views enjoyed Trom the home at 2691 Caroline Avenue.
i. The existing fake views enjoyed from the property at 2696 Carofine Avenue
will not be adversely impacted by the Appiicants' proposed patio du� to the
elevation difference between the properties and the existing trees on both
properties.
j. The Applicants' request is in harmony with the purpose and intent of the
ordinance.
k. The �ppiicants have aemonstrated that enforcing the provisions of t�e Zoning
Ordinance deprives the Appiicants of the reasonable use of their Property.
l. The Appficants' proposed efevated patio is designed in a way which
minimizes impact of the visual encroachment as opposed to the existing
efevated deck.
m. The Applicants' request is in harmony with the purpose and intent of the
ordinance.

4. The City Council has considered this application incluciing the findings and
recommendation of the Pianning Commission, reports by City staff, comments by
the Appficants and the public, and the effect of the proposed variance on the
health, safety and welrare of the community.
5. The City Council finds that the conditions existing on this Property are peculiar to
it and do not apply gene�ally to other property in this zoning district; that granting
the variance would not adversefy affect traffic conditions, fight, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the Applicants, but is necessary to alleviate a practical difriculty;
is necessary to preserve a substantial property right of the Applicants; and would
be in keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIOf�S, ORDER AND C�NDITIOhS
Based upon one or more of the above findings, the Orono City Council hereby grants
variances to Orono Municipal Zoning Code Section 78-1279(6) to alfow construcfion of a new
above grade patio ahead of the ave�age lakeshore setback in conjunction with the construction
of a new singfe family residence on the Property, subject to the folfowing conditions:
1. Council approval is based on the survey submitted by the Applicants and annotated by
City staff, attached to this Resofution as Exhibit B. Any amendments to the site plan
which are not in conformity with City codes will require further Planning Commission and
City Council revi�w.
2. Proposed hardcover fevels are conforming to the Tier 1 standards and no hardcover
variances are gran'ted.
3. Authorities granied by this resoluiion run with the property not with the Appiicants, but
are permissive only and must be exercised by obtaining a buiiciing permit for the home
which includes the proposed patio and commencinr� construction of said project. A
Traming inspection must be completed for the home within one year of tne date of
Council approval, or tne variance for the patio will expire on that date (November 25,
2014).
4. Violation of or non-compfiance with any of the terms and condiiions of this resoiution
shall constitute a vioiation of the zoning code, shall automaticalty terminate any authority
granted herein, and shall be punishabfe as a misdemeanor.
5. The undersigned Applicants have read, understand and hereby agree to the terms of
this resolution and on behalf of the Appiicants and the Appficants' heirs, successors and
