not grant permission for additional or related work which requires separate
permits. A(I provisions of laws and ordinances goveming this type of work

expire and become null and void if construction authorized is not

On January 16, 2015 the City received an updated survey for the proposed new single family home at 2490 Carman
Street. Staff conducted a preliminary review based on the information provided and recommends the following items
be submitted or revised in order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. The City Engineer has reviewed the survey and made the following comments. Please
provide two copies of an updated, full size certificate of survey which meets all of the City's survey standards
(enclosed) addressing the comments below.
a. Building permit sheet A-3 shows a "grill". It is unclear on the survey if a patio is shown or if it's a
contour line. Please clarify.
b. All comments are based on the assumption that the driveway easement for 2470 across 2490
Carman way has been granted. Please provide a copy of the recorded easement for the file. ��d ' �N �1�'
c. The drainage swale on the east side of the property as shown is adequate, however the neighboring
property's grading plan shows a similar swale that is shared by both properties. The shared swale is
preferred if agreed to by both property owners. An agreement should be entered into by both
property owners prior to the commencement of any grading operations.
d. The silt fence as shown should be sufficient, however will need to be coordinated with the
neighboring property to the east if construction occurs concurrently.

2. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District.
Hardcover calculations were submitted on the survey. Please have the surveyor prepare hardcover
calculations, showing proposed hardcover using the City's hardcover calculation worksheet. Attached is a
copy of our hardcover information packet.
3. Separate Permits Required for:
Sewer connection
4. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement
to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will
guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required
escrow amount for this project is $2,500. We acknowledge receipt of$2,500 from Stonewood, LLC for the
escrow, but be aware per the City's policy the escrow money will be refunded to the property owner of
record at the time of release.
PLEASE NOTE: 2015 NEW PERMIT REQUIREMENT: Prior to the commencement of a� exterior/landscaping
improvements, i.e. patios,grading,sidewalks, retaining walls, etc., a Zoning Permit is required.

After a cursory review of the buiiding permit application:
• Based on a FFE of 944.85' the lowest level of the home does not meet the definition of a basement. The third
story is not a half story therefore the house is defined as a three-storey house. Please have the surveyor show
the 938.85' contour(944.85' less 6 feet=938.85') on the survey.

basement shall be considered as a story for purposes of determining the number of stories in a building, when
the finished surface of the floor above the basement is more than six feet above the existing ground level for
more than 50 percent of the basement's perimeter. The perimeter of the basement does not include portions of
the house or garage that do not have a lower level but are merely "unexcavated". Artificially raising the grade
adjacent to the foundation of a structure (by filling or by a combination of filling and retaining wallsJ above the
surrounding natural terrain shall not be al/owed as a method for converting a defined story to a defined
basement, regardless of any other benefits to the property of such action. Finished grade that increases more
than one foot from existing ground level shall be considered as artificially raising the grade. However, artificially
raising the grade when such action merely restores a previously excavated site to its original natural grade may
used as a method for converting a defined story to a defined basement.

ORONO, a Minnesota municipal corporation ("Cit�')and �L�( C /VI.GY(�� ("Owners").
Recitals
1. Construction of the new residence located at 2490 Carman Street, the ("Subject
Property"), legally described as Lots 10 and 11, Block 1, Navarre, and that part of Lot
5, Block 1, Lehman Lagoon, lying West of the Northerly extension of the East line of
Lot 10, Block 1, Navarre, in Orono, Hennepin County Minnesota, is the subject of
building permit application number#2014-01488 has been completed.
2. Winter conditions currently prohibit completion of exterior improvements,final grading, and
vegetation establishment. An as-built survey cannot be accurately conducted at this time.
3. Owners request the City issue a temporary certificate of occupancy("TCO")to the Owners
so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement,the Owners shall deposit$10,000 with the City. All accrued interest, if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure comp�etion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of$500,
or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with
expenses the Owners would be responsible for under a building permit application. The escrow will also
guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work
is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City
Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions
associated with the work and to repair any damage to public property or infrastructure that is caused by the
work (including planning, engineering, or legal consultant review) associated with building permit#2014-
01488 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the
Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when all requirements related to the project are complete. City Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have been
successfully completed and whether it is appropriate to return the funds. Owner may also request the
release of the funds, and such funds shall be released upon City Staff receiving the appropriate verification
that all requirements of the project have been successfully completed.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors; the right to enter upon the subject property for the specific purpose of
inspecting and compieting any exterior improvements, final grading, establishment of vegetation and the
restoration of the subject property should the Owners not complete the work by the specified dates.

newly created lot is 2490 Carman Street(PID 20-117-23-12-0065). Please update your records.
After a cursory review of the building permit application:
• Based on a FFE of 944.85' the lowest level of the home does not meet the definition of a basement. The third
story is not a half story therefore the house is defined as a three-storey house. Please have the surveyor show
the 938.85'contour(944.85' less 6 feet=938.85') on the survey.
easement means that portion of a building that is partly or completely below the existing ground level.A basement
shall be considered as a story for purposes of determining the number of stories in a building, when the finished
surface of the floor above the basement is more than six feet above the existing ground level for more than 50
percent of the basement's perimefer. The perimeter of the basement does not include portions of the house or
garage that do not have a lower level but are merely "unexcavated".Artificially raising the grade adjacent to the
foundarion of a structure(by filling or by a combination of filling and retaining wallsJ above the surrounding natural
terrain shall not be allowed as a method for converting a defined story to a defined basement, regardless of any
other benefits to the property of such action. Finished grade that increases more than one foot from existing
ground level shall be considered as artificially raising the grade. However, artificially raising the grade when such
action merely restores a previously excavated site to its original natural grade may used as a method for converting
a defined story to a defined basement.
• The resolution needs to be signed by the Mercers. They will both need to come into the office with a valid form
of identification to have their signatures notarized.
• Enclosed is an updated escrow agreement. Our records indicate the variance escrow for#14-3676 was paid by
Stonewood, LLC. Please have the property owners sign the updated escrow agreement and note that the
escrow money is refunded to the property owner of record at the time of escrow refund request.

• Your project may trigger the Minnehaha Creek Watershed District's (MCWD) perrnitting requirements; please
contact the MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will not issue
a building permit without a copy of MCWD permits or documentation from the MCWD stating the proposed
project does not trigger any of their permitting requirements.
