On January 3, 2015 the City received a building permit application for a new single family home at 2470 Carman
Street. Staff conducted a preliminary review based on the information provided and recommends the following items
be submitted or revised in order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. The City Engineer has reviewed the survey and made the following comments. Please
provide two copies of an updated,full size certificate of survey which meets all of the City's survey standards
(enclosed) addressing the comments below.
a. All comments are based on the assumption that the driv way easement for 2470 across 2490
Carman way has been granted. �� (rl� S�1►'C��"�7�Ci
b. The drainage swale on the west side of the property is shown as extending onto the neighboring
property. An agreement should be entered into by both property owners prior to the
commencement of any grading operations. If not agreed to by both owner the grading plan must be
redone to show all grading operation contained on 2470 lot.
c. The erosion control plan (silt fence placement) appears sufficient to deal with the erosion, however
is depicted as extending onto the neighboring property to the west. An agreement should be
entered into by both property owners prior to the commencement of any grading operations. If not
agreed to by both owner the erosion control plan must be redone to show all silt fencing contained
on 2470 lot.
d. The silt fence shall be installed and inspected by the City prior to any land disturbing activities. The
Contractor must provide a minimum 24 hour notice prior to inspection.
2. Wetlands. Based on our available information, it appears there is a wetland within the subject property.
This wetland appears to be located within 150 feet of the proposed project. Because Orono City Code
requires a 35-foot setback from any wetland for structures or hardcover,the location of the wetland must be
�� indicated on the survey. Setbacks must be verified with wetland delineation information. For further
informati please contact the Minnehaha Creek Watershed District at 952-471-0590.

A Level 2 delineation shall include the exact surveved boundarv of the wetland shown on the
certificate of survey.
3. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District.
Hardcover calculations were submitted on the survey. Please have your surveyor prepare the hardcover
calculations using the City's hardcover calculation worksheet. For example, additional clarification is need for
house,screen porch, deck and patio area. Attached is a copy of our hardcover information packet.
4. Separate Permits Required for:
a. Sewer disconnection/reconnection
b. Demolition

improvements, i.e. patios,grading, sidewalks, retaining walls, etc., a Zoning Permit is required.
Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please contact
the MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will not issue a building

I visited 2470 Carman St in Orono today to investigate an area in the northeast corner of the property where some data
showed a potential wetland that wouid be within 150' of the proposed work. In fact, there is no wetland on site and the
entire area of interest is planted with sod (see attached) so I do not beiieve that a delineation should be required for the
permit application to the City.The landowners are 1eff&Jacqui James, contractor is Nick Spalding with Spalding Roofing.

The as-built appears to conform to the intent of the approved plan addendum.
An inspector should conduct a site visit and confirm the following:
1. The survey accurately depicts conditions on the ground.
2. The site is stabilized to the point the any remaining erosion control can be removed.
3. The Drainage pattern on the east side of the home does not direct surface water onto the neighboring property.

2. Winter conditions currently prohibit completion of exterior improvements,final grading,and
vegetation establishment. An as-built survey cannot be accurately conducted at this time.
3. Owners request the City issue a temporary certificate of occupancy("TCO")to the Owners
so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement,the Owners shall deposit$10,000 with the City. All accrued interest,if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, fina� grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred(including planning,engineering,in excess of$500,

the Owners when all requirements related to the project are complete. City Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have been
successfully completed and whether it is appropriate to return the funds. Owner may also request the
release of the funds,and such funds shall be released upon City Staff receiving the appropriate verification
that all requirements of the project have been successfully completed.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shali have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat.§§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees,officers and contractors,the right to enter upon the subject property for the spec�c purpose of

On February 12th you stopped into our office and we discussed various scenarios for the property addressed 2470
Carman Street. Below is a summary of our conversation:
• The paver patio on the south side of the property can be replaced in-kind with a permit. The patio can be made
smaller without council approval, but a change in shape, even resulting in the same square footage, cannot be
approved administratively especially if it exceeds or extends beyond the existing footprint. A fire pit cannot be
added. If excavating materials to replace the patio in-kind, a cross-section with material detail is required. A
Zoning Permit is required.
• You indicated you would like to scrape the sod off the southern side of the lot, install an irrigation system, gently
grade out the area, and lay sod back down. This activity is allowed within 75' of the lake, up to 50 cubic yards
