A RESOLUTION
EXTINGUISHING CONDITIONAL USE PERMIT APPROVED
AS RESOLUTION 3561
WHEREAS, John B. Goodman Limited Partnership, a Minnesota limited
partnership (hereinafter the "Owner"), is the owner of the property legally described as:
Tract B, Registered Land Survey No. 1630, Files of the Registrar of Titles, in and for
Hennepin County, Minnesota (hereinafter the "Property");
WHEREAS, Freshwater Foundation was previous owner of Property, and
received a Conditional Use Permit to use the facility as a research and educational center on
May 22, 1995; and
WHEREAS, this Conditional Use Permit was approved via Orono Resolution 3561
and was recorded at Hennepin County on June 10, 2996 as document 2711570; and
WHEREAS, Owner requested the Conditional Use Permit be extinguished
formally by Council action on December 4, 2015, as the Owner does not operate a research and
educational center.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota
hereby approves the requested extinguishment of the Conditional Use Permit as described above
based on one or more of the following findings of fact concerning the Property:
FINDINGS OF FACT:
1. The original Conditional Use Permit application was reviewed as Zoning File #2013.
2. The Property is located in the B-4, Office and Professional Business Zoning District.
3. The Property is proposed to be used as an Office building, which is a permitted use in the
B-4 zoning district.
ANALYSIS:
1. "The Owner does not conduct research or education activities requiring a conditional use
permit.
CONCLUSIONS ORDER AND CONDITIONS:
Based upon one or more of the above findings, the Orono City Council hereby vacates or
otherwise repeals the Conditional Use Permit approved via resolution 3561 in May, 1995.
