Subject: Assessment for Navarre Water Treatment Plant Upgrade
Re: 2414 Carman Street
This project will have one $350 assessment per residential water connection. In situations where an
individual owns several separate contiguous tax parcels with only one residence, only one
assessment unit will be charged.
Any further development of addition houses will require the proper zoning approvals and payment
of a connection charge for hookup to the Navarre Water System.

In return for issuance of said Demolition Permit, the undersigned owner
hereby agrees as follows:
1. The structure (s) shall be kept enclosed and secured until such time
as demolition is complete.
2. Demolition debris will be kept off adjoining property and/or the
public rights of way unless specific prior approval is obtained �
in writing for temporary use thereof.
3. All demolition debris will be completely disposed of off site in
an approved landfill and in accordance with all applicable PCA
requirements.
4 . Upon completion, and within 5 working days of superstructure removal ,
the site shall be left clean and clear of all debris , with any
foundation or other excavation filled with earth, level with the
adjacent ground elevation, except when such excavation is to be used
as part of a new building and such new building is actually under
construction.
5. The undersigned owner shall and hereby does indemnify and hold
harmless the City of Orono, the City Council, and the agents and-
employees of the City from and against all claims, damages, losses
or expenses, including attorney fees, which the City, City Council
and agents and employees of the City may suffer or for which it may
be held liable arising out of or resulting from the assertion against
them of any claims, debts or obligations in consequence of the
demolition described herein as performed by the property owner, his
employees, agents or subcontractors, whether or not caused in part
by a party indemnified hereunder.
6. The undersigned property owner declares that all facts and
representations stated herein are true and correct, and agrees to
do all work in rict accordance with the ordinances of the City.

WHEREAS, Michael J. Pudil and Gail R, Pudil (hereinafter the "Owners") are
owners of the properties within the City of Orono (hereinafter the "City") located at 2414 and

addition to the house on Lot 2 that would encroach into these easements; and

held a public hearing on the application on August 21, 2006, at which time all persons desiring to

WHEREAS, the City Council reviewed the application at recular meeting held
on August 28, 2006 and hereby makes the following findings with re�ards to this application:
FINDINGS
l. This application was revie�ved as Zonin� File #06-3222.
2. The City has no utilities in these easements and does not need them for drainage.
3. Letters have been received from CenterPoint Energy (gas), Xcel Energy
(electricity), Qwest Comnlunications (telephone) and Mediacom (cable) stating
they have no objection to the vacation.
4. The easements proposed to be vacated were intended to provide for drainage and
utilities for a house on each lot and are unnecessary because there ��ill be only
one house on the two lots.
CONC]LUSIOI�S, ORDER AND CONDITIONS
?`rTOW, THEREFORE, BE IT RESOLVED, that based upon the findin�s noted
above, the City Council of the City of Orono hereby vacates the draiilaQe and utility easements
