Hi Melanie, nice talking to you this morning. As we spoke, in addition to replacing my fence I'd like to fix the grade at
the corner of my lot. The rain pools where my fence is along Co Rd 15 and keeps my side yard pretty wet due to it being
lower than Carman St. I want to fill in where it dips and berm it up slightly, so the rain drains to Carman St correctly and
provides a bit of lift for planting some bushes (I plan on planting arborvitae between the fence and those pine trees to
help screen my house from the street).
It should only take a couple days and I'll make sure to put up a silt fence for erosion control.
I left the completed form and redlined survey at your office this morning, so please let me know if there is anyhting else
I need to do in order to get started.

Greetings Christine, I'd like to set up a time to meet with Lyle to go over a couple things on my and a neighbor's property,
and I understand he has been working with my dad on his property at 2447 Carman St.
1. My neighbor Julie Gatehouse (2443 Carman St) would like to hire me to repair and "beautify" an existing wall
located along the backside of her property, and plant some arborvitae to provide screening from her neighbor's
garage. I need to know if since the wall will be under 4ft I shouidn't need a permit, but it is next to her lot line,
which according to the rules might require a CUP?
2. I am in the process of designing an addition at my property (2413 Carman St) for construction next year, and
would like to know how much I can expand without violating the hardcover surface rules, setbacks, etc.
Please let me know what time will work for Lyle or another municipal representative, my phone number is listed below.

Subject: Corrected Information-2413 Carman Street
Late Friday afternoon I realized the information I had sent you was about 2447 Carman
Street rather than 2413. I had been researching a question for Ms. Gatehouse and was
looking at the aerial photos on the Hennepin County website. Thinking of neighbor as
"next-door neighbor" I checked the owner of each parcel, saw that 2447 was owned by a
couple named Bluth, and went off down the path of error.
Regarding 2413:
Because the zoning code defines the front of the lot on a corner lot as the narrower of the
two street frontages, the frontage Shoreline Drive is the front lot line. This makes the
setbacks as follows:
Shoreline Drive �o ty Rd. 16) - 30 feet
Carman Street - et ---- 3 D
South property in - 30 feet
West property line - 10 feet
The lot is subject to the 15% coverage by buildings/structures more than 6 feet tall. Based
on a 1988 survey (by the predecessor firm to Mark Gronberg and Associates) the lot is
21,000 square feet (but this is including the triangle at the street corner that was later
acquired by the County for street right of way). This would put allowable coverage at about
3,150 square feet. According to the survey coverage is about 2,000 square feet for the
garage, a shed, and house without the sunroom.
The property is also subject to hardcover regulations. The property appears to be within
the 250 to 500 foot zone, which would allow 30% of the property to be covered by partially
or fully impervious surfaces. The 1988 survey has hardcover at 20.3%. The sunroom
appears to have been constructed over existing hardcover.
A current survey would be required to obtain a permit. It could be done by Gronberg or
any other surveyor.

I'm responding to your email sent to Christine Mattson since I'm also responding to some
questions from Ms. Gatehouse. There is good news and there is bad news:
1. Regarding the retaining wall, as long as you would be putting back a wall that is the
same height and in the same location, it could be done as a replacement of a non-
conforming structure, which is allowed by state statute. If it was a total replacement
a zoning permit would be required and if you were disturbing the neighbor's
property, consent to the disturbance. If you are repairing by simply pulling out and
replacing pieces of the wall (assuming it is made of stone, block, or timbers) a permit
would not be required. If you were replacing sections of the wall from bottom to top a
permit would probably be required but we would have to know the extent of the work
before we make a determination.
2. Regarding your house, it appears nothing could be done without variances. On a lot
less than 10,000 square feet the zoning code allows 1,500 square feet of buildings
and structures more than s� feet tall. From the file the house and garage appear to
be 1,652 square feet. There is a permit for an entry but no plans so I don't know how
big it is or what it is. There are decks that might counted if it is more than six feet
from the ground to the top of the railing at any point. Hardcover (anything
impervious or partly impervious) is regulated on the property. It appears to be
partially within the 75 to 250 foot zone (measured from the lake) where 25 percent
hardcover is allowed and partially in the 250 to 500 foot zone where 30 percent
hardcover is allowed. There are no hardcover calculations in the file. Nothing has
been built since the garage/entry and rear additions were built in 1977. Hardcover
calculations were apparently not required in 1977 as there are none in the �le.
Council is hesitant to grant variance to a house to be enlarged when it already
exceeds the allowable size unless it can be demonstrated that the addition is
absolutely essential. One request that was approved involved enlarging the entry on
a split-level house where the front door entered on to a 3 foot deep landing on the
stairs so someone standing behind the door could be pushed down the stairs if the
door was opened. If you wanted to pursue this you would need a survey of the
property showing all hardcover with hardcover calculations before you met with staff
to discuss the variance process.
