KOZLAK and JODEEN A. KOZLAK (hereinafter "Owners") are the owners of the property located at 1635 Bohns Point Road within the City of Orono (hereinafter "City") and legally described as: Tract B, Registered Land Survey No. �65, files of the Registrar of Titles, Hennepin County, Minnesota (hereinafter "the Property"); and WHEREAS, on August 24, 2009 the City Council of the City of Orono adopted Resolution No. 5860 granting the Property average lakeshore setback, lakeshore setback, structural coverage, and hardcover variances so that additions to the existing residence could be constructed. The approval remained valid if a building permit for the residence was issued by August 24, 2010; and WHEREAS, since a building permit has not been issued the Owners have made application to the City to renew the approval, with no change in the plans; and WHEREAS, Resolution No. 5860 was inadvertently recorded without the hardcover summary as part of Exhibit A. WHEI�EAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on July 19, 2010, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. Immediately following the public hearing the Planning Commission recommended approval of the application by a vote of 5 - 0. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota that Resolution No. 5860 is amended to change the deadline for obtaining a building permit to August 24, 2011 and to add the hardcover summary attached as Exhibit A as the second and third pages of Exhibit A to Resolution 5860. Resolution No. 5860 otherwise remains in effect.
