Kaley 139 Brown Road South Wavzata MN 5391 Dear Mr. Kaley: Your application for a permit to build an attached garage is denied because the garage does not satisfy the setback requirements. You need to change the location of the garage or apply for a variance. I am enclosing a variance application as well as your application, plans and check for the plan review fee. The next deadline for a variance application is April 22. As we discussed in the office previously, there are certain building code provisions that state law does not allow a City to grant a variance from: • An eave may overhan the 3 foot setback from the property line by only 12 inches, not the 24"proposed by your plan. • An eave may not overhang the street right of way (property) line. If you should have any questions feel free to eall me at 92-249-4623. New On-site Installation or Addition Required • For all new construction outside districts served by municipal sewer. • Anytime the existing is classified non-conforming or when the addition of bedrooms, installation of mechanical or plumbing equipment, or other factors are likely to affect the system. Procedure for On-site Installation or Repair • A State Licensed Designer(1 or 2) must perform soil testing and the system design. • Distribute report to contractors for bidding. • A list of state licensed contractors can be found at www.pca.state.mn.us/proqrams/ists/ists.xls. General Information When planning new home construction or additions to an existing home, both primary and future drain field sites must be preserved for the long term use of the property. All setbacks and property lines must be verified prior to the issuance of a septic system permit. Once drain field sites have been verified, snow fencing must be placed surrounding sites to prevent them from damage. Vehicular traffic; such as cars, trucks, earth moving equipment, etc. could compact drain field sites, rendering them unusable, prohibiting the timely completion of the project and or limit the long term use of the property. Snow fencing must be in place prior to the issuance of a building permit. WETLAND DELINEATION, WETLAND BUFFER EVALUATION AND BUFFER IMPROVEMENT PLAN (see page 23) A wetland delineation is required if there is a wetland on or close to the property. *'"*"`A VARIANCE !S NOT A BUILDING PERMIT"'"`'`* If your variance is approved, you have one year in which to apply for a building permit. See the inspector for any additionat information which may be required at that time. Note that the permit can be issued only within the limits of approval: do not relocate or enlarge a building after approval or a new variance may be required. - 7 -
