This property is zoned Rural Residential 1-B. Horses owned by residents of the property are a permitted accessory use. There are limitations on the number of horses and where they may be pastured. The code requires two acres of pasture for the first horse and one acre of pasture for each additional horse. Pasture cannot include wetland or the wetland buffer. There must be on acre of non-wetland, non- pasture around the house. The drain field for the septic system cannot be within the pasture. According to the tax data this property is 10.81 acres. There are two wetlands on the property. We do not have information on the size of the wetlands. The east wetland requires a 35 foot buffer and the west wetland a 16.5 foot buffer. A rough approximation, based on an aerial photograph in the wetland delineation (figure 5), shows there appears to be enough land for one horse. It is not possible to determine more than this without a survey that shows the location of the wetlands, the buffer areas, the houses, etc and includes area calculations. With a conditional use permit the number of horses could be increased, but the impact on the wetland would be an issue. It consists of the main house, and according to the listing agent, a"legal guest quarters", in addition to a pond. My questions for you are: • In regard to the guest quarters: o Is there an existing agreement, approval, or conditional use permit relative to the structure? Yes there is a CUP and a covenant for an oversized accessory structure. Please see the property street file at City Hall for more information. o Would a change of ownership affect any intended use (in-law quarters)? No. The CUP was filed in the chain of title with the property, not the owners. • Can the guest structure be remodeled, and/or added onto without a variance? Internal remodel that does not create additional bedrooms may be possible. The guest house (or barn) is approximately 1,600 s.f., Hennepin County lists the area of the property as approximately 10 acres. *Orono's oversized accessory structure ordinance would permit one oversized accessory structure on the property up to 3,000 s.f. and a total of all accessory structures on the property at 6,000 s.f.. However, as this property has wetlands and is served by a septic system sized for 6-bedrooms (which is shared with the house) there may be other limiting factors to enlarging the barn. • Wetlands o Is the pond or any adjoining low lands in a designated wetland? Yes, please see the Wetland Delineation (dated 10/23/06) on file at City Hall. The MCWD may require an updated delineation prior to issuance of any permits. o If applicable, what are the building setbacks from any designated wetlands? According to our wetland map the wetland on the east of the property is classified as a Manage 1 requiring a 35' buffer and a 20' structural setback from the buffer; the wetland on the western portion of the property is classified as a Manage 2 requiring a 25' buffer and a 20' structural setback from the buffer. • Septic i � � o I'm told the house and guest house share a septic site. Yes, please see the property information on file at City Hall. ■ Do you have any files on it, and if it would allow additional bedrooms or baths? According to our records the existing septic system is currently sized for a maximum of 6 bedrooms.
