WI�EREAS, Alexander 3ohnston and Catherine Johnston, (hereinafter "the
applicants ) are the owners of the properry located at 940 Bzown Road South �vithin the City of
Orono (hereinafter "City") and legally described as:

2, The property is located in the RR-1B Zoning District, w-here 2 acres or 87,120 s.f.
' is the minirnum lot area, The property consists of 9 acres of which 4.55 acres is
dry contiguous.
3. The Planning Comrnission reviewed this application on May 17, 1999 and
recouunended approval on a vote of 4 to 0. �

4. The Plannin� Commission made the fotlowing findings of fact:
A. A property is required double the lot area for the zoning district to allow
a guest house. The property is located in the RR-1B, 2 acre zoniug
distriat. The subject pro�erty co:�tains 4.55 acres of dry contiguous
bu.ildable Iand.
B. The use of the barn as a �uest house wzll not exceed the 2 acre per
"dwelling unit" density.
C. The guest house meets all required principal buitd'zng setbacks.
D. The bazn is 1,664 s.f. quaiifying as an o�versized accessory structure
requiring a restricdve covenant being recorded on the chain of title.
E. The property has a non-conforming septic system that is scheduled to be
replaced in 1999. Prior to a final plumbing inspection, the septic rnust ba
installed and approved by the City.
5. The City C�uncil fmds that granting a conditional use permit to allo�v a guest
house�vill not be detrimenta�.to the health, safety or general weLfare of the public,
w-ould not adversely af�ect Ligk�c, air nor pose a fire hazard or other danger to
neighboring properties, nor will its use depreciate surrounding property values and
that the propose�le�vel of use of khe property will be in keeging with the intent
and objectives of the Zoning Code and CompKehensive Plan of the City.
� 6. The City Council has considered chis app�ication including the findings and
recommendatioos of the 1'lanning Commission, reports by staff and comments af
the applicant an.d the affect of the proposed use on the health, safery, and �veLfaze
of the community.
C4\`CLUSIONS, ORDE�t AI�ID CONDTTIONS
� Based upon one or more of the findings noted above, the Orono City Council
. hereby grants a conditional use permi.t per Municipal Zoning Code Section 10.20, Subdivision
3 (G) for a guest bouse, subject to the following condi#ions:

1. The property owners file a res�ictive covenant on the property for an oversized
acccssory structure and a guest house_
2. The final inspection foz the plumbing wil� not be appro�ed before the septic
system has been zeplaced and approved. .
3. Authorities granted by this resolution are pernussive only and must be exezcised
by application for a building permit vt�thin one year of the date of Council
approval or tfus conditional use peznnit �r-ill expire on that,date (May 24, 2000).
4. Violation of or non-compliance wit:z any of the terms and conditions of tlus
resoluiion shall constitute a violation of the Zoni.ng Code, shall automatically
terminate any authority granted herein, and shall be punishable as a rnisdemeanor.
5. The undersigued applicants have read, understood and hereby agree to the terms
of this resolution and an behalf o:themselves, their heirs, successors and assigns,
herebS� a�ee to the recording of this resolution in the chain of title of the
property.
