DESCRIPTION OF VIOLATION: The City has been attempting to have junk cars removed
from this property since 1991. When threatened with legal action, some cleanup is done but then
vehicles reappear. Numerous neighbors have lodged complaints against the property and are very
upset with the lack of progress.
The City's objective is to require the owner to remove all unlicensed inoperable vehicles and to
maintain the property in a neat, clean and presentable manner.

Dear Mrs. Smith:
Thank you for your efforts to keep the yard somewhat free of unlicensed inoperable vehicles for
the last year. In the past, I had hoped that if the vehicles were to the rear of the buildings that
the complaints regarding your property would stop. They did stop for a period of time but it
has now become an issue again and has become an issue with a state agency.
The City has changed its policy on how to deal with unlicensed inoperable vehicles. Instead of
issuing citations and going through the court system, the City is enforcing a state statute that
allows the City to tow unlicensed vehicles from the property and dispose of them.
Therefore the City must require you to remove all unlicensed inoperable vehicles from all of the
property by May 1, 1995. If this deadline is not met, the City will tow the vehicles and dispose

The City is again receiving complaints about unlicensed inoperab(e vehicles stored on your property.
On � recent sit�e inspection, ll�ere were 17 vehicles stored illegally. Therefore tlle City must require
you to �nake the vehicles operable and licensed or remove them from the property. The 2 or 3 tnicks
that have sentimental value may be allowed to remain unless the City received complaints about
thein also.
The City has attempted to work with you on this problem in the past wit(1 little results. Therefore
the City must require compliance before November 20, 199�. If this deadline is not met,�the City
�vill issue citations and refer the matter to the City Attomey for further legal action. The City �vill
.ake �vhatever steps necessary to insur�e compliance. Any legal action taken �vill not be l�alted until

Dear Ms. Smith:
Spring is here and we need to start getting the unlicensed inoperable vehicles off your property
again. The City and the community has been more than patient with this problem. The Ciiy has
been understanding of the family problems you have relating to the cars; however, it has gone on
much too long. A new deadline of May 27, 1996 must be met. No excuses will be acceptable. If
this deadline is not met, citations will be issued and you will be required to appear in Court before
a judge. There are several ads in the Minneapolis Star and Tribune and the local paper from people
who will haul the vehicles away for free.

For several years the City has asked you to remove or repair and license the unlicensed/inoperable
vehicles on your property. This includes the piles of junk and other debris on the property. In the
past two years several vehicles were removed as requested only to be replaced by other unlicensed
vehicles. As you know, this is a violation of the City of Orono Municipal Codes. There are 15 to
17 vehicles that are unlicensed or inoperable and many piles of tires,automobile parts and other junk
on the property as of April 7, 1997.
This is your final notice! All the vehicles on the property must be licensed and shown to be operable
by April 20, 1997 or a formal complaint will be filed abainst you. Automobile frames, piles of car
parts and tires, and other junk must also be removed by the deadline date.

Dear Mrs. Smith:
The City asked you to eliminate the unlicensed/inoperable vehicles as well as the piles of junk on
your property by April 20, 1997. An inspection performed on Apri121, 1997 revealed that many or
all of these vehicles and junk piles still remain on the property. In addition, we observed that a six
foot high fence was installed very near the east property line (adjacent to the street) and by the
detached garage. Orono Municipal Codes require that fences be confirmed as being within the
property and in the front yard must not exceed 3.5 feet high, but fences 6 feet high are allowed in
the back yard. The fence in the front yard must therefore be confirmed as being within the property
and altered to meet the 3.5 foot height requirement or be removed by May 7, 1997.
This is your final notice! All the vehicles on the property must be licensed and shown to be operable
by May 7, 1997 or a formal complaint will be filed against you. The fence, automobile frames,piles
of car parts and tires, and other junk must also be removed by the deadline date.

fence from your property many times. An inspection performed on June 9, 1997 revealed that many
or all of these vehicles and junk piles still remain on the property.
The vehicles and junk must be removed from the property by June 18, 1997 or the City will have
them removed from the property and shall certify all costs to your property as a special assessment
as per Orono Municipal Section 9.50 (enclosed). Vehicles which are more than seven years old,
lacking a license and missing vital component parts will be subject to immediate sale. The
remaining vehicles may be reclaimed within ten days, after payment of all towing and storage costs.
The fence must be removed by the June 18, 1997 deadline or a citation will be issued. Failure to
comply with the conditions of the citation could result in up to 90 days in jail or a fine of up to $700.

An inspection was conducted today on your property at 445 Brown Road South. I would like to
thank you for the progress so far. I spoke with Bev Silberman after the inspection and she indicated
that a person was coming to pick up the rest of the items soon. There is a few more cars and parts
of cars left to go. The City will hold off action on removing the items until6-30-97. If they are still
on the property at that time they will be removed and the cost will be assessed to your property as
a special assessment. I apologize for the stress this situation has cause you, if unlicensed/inoperable ,
vehicles are kept off the property in the future the city will not need to take these actions. If you have

Conditions exist on the indicated property which constitute a violation of
the following section(s) of the Orono Zoning Ordinance:
X SEC. 9.50. JIINR CARS. FURNITURE� HOIISEHOLD FDRNISHINGS AND APPLIANCES
STORED ON PIIBLIC OR PRIVAT$ PROPERTY. It is unlawful to park or store
any unlicensed, unregistered or inoperable motor vehicle lacking
essential parts, household furnishings or appliances, or parts or
components thereof, on any property, public or private, unless housed
within a lawfully erected building. Any violation of this Section is
declared to be a nuisance and upon seven days written notice to the
owner, as shown by the records in the office of the County Auditor, of
private premises on which such material is found, the City-,may remove
the same and certify the cost of such removal as any other special
assessment. For the purpose of this Section, an inoperable motor
vehicle shall be defined as lacking, including but not limited to,
parts essential to operation, such parts being wheels, tires, motor,
drive train, battery, or having two or more flat tires, or having the
interior, including the driver's position, used for storage in such a
manner that no person can operate the vehicle.
SEC. 9.55. MAINTENANCE OF PRIVATE PROPERTY-
X Subd. 1. It is the duty of the owner of every vacant property and the
owner and occupant of every occupied property to maintain same in a
neat, clean and presentable manner free of any junk, debris, refuse,
litter, dead trees, or noxious weeds, and to remove all other public
health or safety hazards therefrom.
Subd. 2. Grass and Weeds. The owner or occupant of every lot or
parcel shall regularly cut or otherwise maintain all grass and weeds
thereon at a height of not more than six (6) inches.
Please take action to comply with the above ordinance reauirement(s ) by
NovembPr 11 . 1991 _ A follow-up inspection will be made at that time to
verify compliance.
