We have reviewed the revised grading plan dated 8-14-OS for the proposed improvements to879/849
Brown Road North. We have the following comments with regards to engineering matters:
• The grading plan adequately addresses the issues raised in our 7-12-OS comment letter and is
acceptable.
• Erosion control measures around the perimeter of the property should be installed,inspected
and approved by the city prior to any work on the site.

The new survey has just been dropped off in your office, The following is an
update of where we are at with the items you asked us to address in your 7.11.05
letter and 7.20.05 fax.
July 11, 2005 letter:
Item #1: The two lots have been legally combined. The paperwork was turned
in by David Carlson of Wilson Management 7.21.05.
Itern #2: Wall #3 over previous lot line - No longer valid as the two properties are
now one. There will be no walls greater than 4` tall.
Item #3: 75' structure setback from Dickey Lake Creek — a new survey has been
dropped off at your office that shows this item.
Item #4: Fill —we will be moving 200 yards and importing 200 yards. We will not
extend the berm paralleling Brown Road towards the creek over the 75' setback.
No berms will be over 3:1.
Item #5: You were going to look at this and see if it affected the view. The pool
permit is being applied for by Prestige Pools. The dock: we were tofd to work

with Minnehaha Creek Watershed District and are currently working on permit
with them.

ltem 1: There is no grading to be done between Dickey Lake and the 150'
Setback. There may be minimal grading to level off the dirt to lay sod up to the
patios or edging, or at the house. The existing grade will remain. The existing
natural grasses will remain.
Item 2: drainage at the property line along the driveway has been improved, with
suggestions from Mark Gronberg, the surveyor and is now shown on the new
survey.
ltem 3: Erosion and sediment control —There is an existing silt fence already on
the property. However, we have applied for a silt fence permit through MCWD to
see if we need another one.
Application for Demolition Permit—
We applied for the permit on 7.19.05 to get the process started. We have
several contractors working on a well abandonment number if needed and any
septic, sewer and water items that need to be taken care of. As of 8.10.05, I
believe they have been taken care of. The contractors are submitting their own
numbers and permits to you.
I hope this covers any and all concerns. If there are still concerns, Please let us
know soon, sv we can do whatever we can to remedy them.

We have reviewed the building permit survey for the properiy located at 8797849 Brown Road North.
The site improvements include the construction of a new home d associated grading. The
following comments with regards to engineering matters are meant t supplement your comment
letter dated July 11, 2005.
� It is unclear what,if any,grading is proposed between Dickey L e and the home. The plans
call for mulch and grass paths along with an area labeled grass est of the home. The plans
should clarify any grading necessary to complete those impro ements shown west of the
home.
• The grading shown east of the home will direct water onto e neighboring properties,
particularly the property to the south. The grading plan shoul be revised to incorporate
swales and other improvements to contain storm water flows n the subject property. The
grading plan should include existing contours extending at least 50-feet beyond all lot lines. ,
� The plans should include appropriate erosion and sediment ontrol measures including
details.

Dear Ms. Blulun:
We are in receipt of your application for land alteration pennits far proposed work at the
above referenced address. The following issues must be resolved before permits can be
issued:
1. The property as depicted on the submitted survey dated June 24, 2005 actually
consists of two separate tax parcels. These must be legally combined Uefore any
permits can be issued for the proposed pool, the driveway, or retaining walls
which are shown exteilding onto both properties. Provide writte�i evide�ice fro�y:

2. It is not clear from your application which walls are proposed. Please confirm
tliat only the walls marked as Walls 1, 2a, 2b, 3, 4 and 5 on,the Tree and Grading
Plan dated 2-14-OS are proposed at this time. Wall 3 appears to extend
approximately 8' over the common lot line, where no grading is normally allowed

3. The survey does not indicate the location of the 75' required structure setback
from the OHWL of Dickey Lalce Creelc, which is subject to Orono's Shoreland
Management Ordinances. The survey rnust be anieizde�l to show t{ie OHWL of
the creek a�id the 75'setback froni tlze OHWL, at all locatiorzs i�i tlie pf�ope�ty.
4. No more than 10 cubic yards of fill/excavation is allowed within 75' of�the
OHWL of the creek per Zoning Code Section 78-1286(b). It appears that a

portion of the proposed berm paralleling Brown Road is less than 75' from the
creek OHWL. It also appears that a portion of the berm has finished slopes
steeper than 3:1 which will not be acceptable. Further, City code requires a
conditional use permit for fill/excavation in excess of 500 cubic yards that is not
associated with driveway or house construction. Co�zfirrn location of 75'creek

The City Engineer was provided with your plans for review as of Friday, July 8;
his comments and any recommendations regarding the grading and retaining walls
should be available shortly.
5. It is our understanding that the pool and the dock are not proposed at this time.
The pool will require a separate average lakeshore setback variance than that
which was processed for the house in 2003. The 2003 review did not include a
pool proposal. This variance can be handled administratively if staff finds that "no
lake views of an adjacent lakeshore lot are obstructed, and adjacent neighbors
provide written approval"per Zoning Code Section 78-1279(6)(a). Such approval
must be processed before a pool permit will be issued.
The dock as shown on the survey will require certain wetland impacts. The City
is under a wetland moratorium until August 23, 2005, pending code revisions that
may or may not impact the proposed dock location, size, construction, etc.
Please provide the information requested above so that we may continue our review. If

We are in receipt of your application for land alteration pennits for proposed work at the
above referenced address. The following issues must be resolved befare permits can be
issued:
1. The property as depicted on the submitted survey dated June 24, 2005 actually
coi�sists of two separate tax parcels. These must be legally combined before any
pennits can be issued for the proposed pool, the driveway, or retaining walls
which are shown extending onto both properties. Provide written evidence from

2. It is not clear from your application which walls are proposed. Please confirm
that only the walls marked as Walls 1, 2a, 2b, 3, 4 and 5 on.the Tree and Grading
Plan dated 2-14-OS are proposed at this time. Wall 3 appears to extend
approximately 8' over the common lot line, where no grading is normally allowed

portion of the proposed berm paralleling Brown Road is less than 75' from the
creek OHWL. It also appears that a portion of the berm has finished slopes
steeper than 3:1 which will not be acceptable. Further, City code requires a
conditional use permit for fill/excavation in excess of 500 cubic yards that is not
associated with driveway or house construction. Confirm locatio�i of 75'creek
setback, eli»ainate froin plans any proposed fill tliat encroaclies tliat setback,
and confirm the volume of filUexcavation iiz the proposed berms.
The City Engineer was provided with your plans for review as of Friday, July 8;
his comments and any recommendations regarding the grading and retaining walls
should be available shortly.
5. It is our understanding that the pool and the dock are not proposed at this time.
The pool will require a separate average lakeshare setback variance than that
which was processed for the house in 2003. The 2003 review did not include a
pool proposal. This variance can be handled administratively if staff finds that "no
lake views of an adjacent lakeshore lot are obstructed, and adjacent neighbors
provide written approval"per Zoning Code Section 78-1279(6)(a). Such approval
must be processed before a pool peimit will be issued.
The dock as shown on the survey will require certain wetland impacts. The City
is under a wetland moratorium until August 23, 2005, pending code revisions that
may or may not impact the proposed dock location, size, construction, etc.

Dear Mike Gaffron,
The new survey has just been dropped off in your office. The following is an
update of where we are at with the items you asked us to address in your 7.11.05
letter and 7.20.05 fax.
July 11, 2005 letter:
Item #1: The two lots have been legally combined. The paperwork was turned
in by David Carlson of Wilson Management 7.21.05.
Item #2: Wall #3 over previous lot line - No longer valid as the two properties are
now one. There will be no walls greater than 4' tall.
Item #3: 75' structure setback from Dickey Lake Creek — a new survey has been
dropped off at your office that shows this item.
Item #4: Fill —we will be moving 200 yards and importing 200 yards. We will not
extend the berm paralleling Brown Road towards the creek over the 75' setback.
No berms will be over 3:1.
Item #5: You were going to look at this and see if it affected the view. The pool
permit is being applied for by Prestige Pools. The dock: we were told to work

with Minnehaha Creek Watershed District and are currently working on permit
with them.

Item 1: There is no grading to be done between Dickey Lake and the 150'
Setback. There may be minimal grading to level off the dirt to lay sod up to the
patios or edging, or at the house. The existing grade will remain. The existing
natural grasses will remain.
Item 2: drainage at the property line along the driveway has been improved, with
suggestions from Mark Gronberg, the surveyor and is now shown on the new
survey,
Item 3: Erosion and sediment control — There is an existing silt fence already on
the property. However, we have applied for a silt fence permit through MCWD to
see if we need another one.
Application for Demolition Permit—
We applied for the permit on 7.19.05 to get the process started. We have
several contractors working on a well abandonment number if needed and any
septic, sewer and water items that need to be taken care of. As of 8.10.05, I
believe they have been taken care of. The contractors are submitting their own
numbers and permits to you.
I hope this covers any and all concerns. If there are still concerns, Please let us
know soon, so we can do whatever we can to remedy them.
