RE: Housing rehabilitation assistance request for the property at 819 Brown Road
Dear Mr. Graham:
This letter is in response to the request by the owners of the property at 819 Brown Road for
rehabilitation assistance. The property in question does not comply with the zoning district
requirements in several respecCs. The zoning district is RR-1B, which is One Family Rural
Residential. This district requires a minimum lot size of two acres, front and rear yard setbacks of
50 feet, side yard setbacks of 30 feet and a minimum width of 200 feet.
The subject property is slightly over one acre in size, has a side yard of 25 feet on the south side and
is 150 feet wide. These measurements are all significantly less than this zoning district allows. The
attached sur��ey shows the lot dimensions in detail, as well as the required setbacks. Unless the size
of the house is increased, these shortcotnings should not be problematic in allowing rehabilitation.
The most serious code violation affecting this property is the nonconforming septic system. 'The
current septic tank has not been pumped since 1978 despite several orders by the city Septic Systems
Inspector to do so. The most recent inspection in 1995 found the current system to be failing and
its replacement is required by December 31, 1997. It is recommended that funds granted to the
owner first be used toward a new septic system before any repairs to the house are made.
Also enclosed you will find the definition of "Lot of Record" from the city code. This property
meets this definition.
