WH�REAS, Dennis L. Platteter a, Uctoher 27, 1�95, filed a formal subdivision
application with the City for approval of a t���o lo:r�;sidential plat of property legally descrihed as:
The South 354.75 feet of tlle East 990 feet, except the North i 50 feet of the East 323.4 feet
thereof, of the Southeast Quarter of the Southwest Quarter of Section 27, To�vnship 118
North, Range 23 West of the Fifth Principal Meridian, (hereinatter "lhe properiy"); and
�'4'H�R�AS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono's zoning, platting and on-site septic codes, the Orono
Plantiing Cornmission held a public hear•in� o�i No��ember 20, 1955, at �t�liich time all persons
desiring to be heard concerning this application ��ere �;iven the opportunity to speak thereon; and
�'�'IIEREAS, at their regular meetin`� hcld on Dccember 1 l, 199�, the Orono Cily
Counci] consiciered the subdivision application of Dennis L. Plattcter noci��g the follo«•in`� findin�s
of fact:
l. The pro��erty is located �vithin the RR-1B Single Family Rural Residential Zoning
District requiring a minimum of? acres of dry contiguous buildable l�Id witliin each
newly created lot.
�. The property contains a total of appro�imatel}� �.64 acres, all of«�hich is considered
dry buildable.
3. The proposed plat contains t«�o lots each meetin� or exceeding the 2 acre rninimum
lot area requirement.
4. The property is located in the Shoreland Overlay District. Lot 1 is a lakeshore lot
contiguous ���ith Dickey Lal:e, a natural environment lal:e. Lot 1 meets the required
200' width at the OI-I�VL, 98�.� elevation, of Dickey Lake and at the 150' building
setback line.

(. The oversized accessory structure at 2,100 s.f. on proposed Lot 2 shall be removed

NO�'�',TH�REFORE,BE IT RESOLV�D,that based upon either one or more of
the findings noted above,the City Council of tl�e City of Orono hereby approves the preliminary plat
for Dennis L.Platteter for the property located at 809 IIrown Road North per the survey dated 11-15-
95, by Mark S. Gronberg of Coffin and Gronberg, Inc., subject to the following conditions:
1, IFthe existing principal structure is to remain on Lot 1, nortl�/south lot line shall be
adjusted so that structure meets required 75' setback from east lot line.
2. Approval of the 2 lot plat and the lot lines as sho��n is based on the removal of all
existin� accessory structures on both Lots 1 and 2.

B. Dedication of"drainage and utility easements" 10' wide along all perimeter
property lines (not to be designated at shoreline of Dickey Lake) and 5' cach
side of internal property lines.
C. Portions of lot located below 98�.5 at northwest corner to be designated as
Dickey Lal:e.
D. Applicant's surveyor to determine if a Type 2 or 3 wetland exists at southwest
corner of property adjacent to shoreline of Lot 1. The City's wetland maps
have located a protected area in that portion of tlle property. If the wetland
exists, it should be located as a drainage easement on tl�e plat.
E. Dedication of 33' of ri�ht-of-way of Bro«�n Road North.
